ILR requirements

Post by latinointheuk » Sun Jul 30, 2023 12:02 pm

good morning guys,
hope you having a good summer? its me again...thankfully to this forum i manage to guide myself to my citizenship for me and son. but i need advice for my partner.

she is on the 10 year route visa, she already has 2 visas(2.5years\) given as compassion, my son was born in the uk and hold a british passaport and so i do, my question is, as she has been more thank 5 years now leagally, can she apply for the ILR before 10 years, as a mother of a british citizen? as the cost for nhs surcharge has gone up we would like to see if we could apply for ILR?

many thanks

Being the mother of a BC does not confer on her additional rights as she is on 10yr route already.
What may have shorten the duration was if you were already on ILR or a BC and she changed to spouse route earlier on.

I agree with AmazonianX advice that she gets no special treatment. She needs 10 years of lawful and continuous residence in order to get ILR. What was her status before getting visa on compassionate grounds?
