This suggests that your extension was granted under the 10-year route. Do you have your extension approval letter ?

Hi,
Many thanks Zimba for quick response:
i have looked at documents and see my observation:
1. The approval letter that came when i first applied visa after marriage and entered to collect BRP
quotes
" your application for UK visa has been sucessful this means when you arrive in uk will have permission to enter as Spouse/CP from 16th july to 16th aprilr2019
2. The next renewal in 2019 i had to do when i was out of UK [In India] and couldnt travel for medical reasons
i collected BRP once reached here.couldnt find any such letter for this
Also i checked on both Visa application forms [2016 and 2019(renewal)]
the Category of visa is: settlement and
Type is WIFE.
Only observation is second BRP ONLY SAYS:
Type of permit as 'Leave to Enter'
and First issued does says
Type pf permit as :SPOUSE/PARTNER and Leave to ENTER
Please suggest if thatmakes sense

Hi Zimba: Datil on my second visa renewal
So my First BRP expiry was:16/04/2019
Just before its Expiry:
I flew to India on 24-dec-2018 and had fertility treament , got medical complication with pregnancy. Was hospitalised and not allowed to travel submitted the same document to visa while renewal.
Per Home office mail they quoted as history in their ILR response now:
"Applicant applied for leave to enter as a spouse on 24 April 2019. This was granted from 04 June 2019 Until 04 March 2022. You entered the UK on 27 June 2019."
I got miscarriage after 5 months so travelled in 27june2019 back to UK
Summarising above :So since secondBRP was valid until 16/04/2019 and i had submitted my visa application [24th aprile 2019]while in India "hospitalised" there is gap of8 days ,i.e
from 16th april to 24th april when application submitted and while i was in India the renewal happened

Well, this changes your case then. The family route has no absence limit but it has a continuous residence requirement. You should have mentioned this in your original query. You failed the continuous residence requirement as you have a gap between 16/04/2019 and 04/06/2019. Given your circumstances, I suggest asking UKVI to exercise discretion in your case. You should argue that you could not return to extend your visa due to your medical treatment and you applied for entry clearance as early as you could.

Many thanks Zimba, i have responded to Homeoffice with Medical certifcates and my rational to be not able to attend appointment on time. As i applied super priority they came back with info on same day that is 19th Nov.
Based on your inputs i wrote back on 21st Nov, i havent heard anything yet. Just wanted to check , do i get response from homeoffice even if they reject my ILR request , as havent heard from them till now so was anxious.
Can i do follow up at least after 1 week with home office

Under the family route, you are often offered an extension if ILR is not possible.

Even though i had applied with priority service i havent heard from Home office for my decision after the response i sent last week for the rational for break in renewal
Wanted to check do they take weeks even for cases with priority in general or its just i am worried for no reason.

Hello
Coming back on my ILR application i submitted , ijust need advise what is best alternate for me to progess as my Dependent visa is nearing to expire:
Just revisiting the details:
1.19th Nov'21:Attended Boimetric , with same day premium service fee paid
2. 19 th Nov21: Home office responded saying ILR Application might not get approved for LOA if i want to change to getting dependent visa app or need to be be reviewed for ILR only
3. 21st Nov,21: I responded with rational as to continue on ILR
Now my dependent visa is due to expire on 3 rd Mar'22 and i am working professional. please advise how do i escalate ,as to avod any delay only i paid for the premium service. I fear if my decision is not recevied and i fell short of time to apply my dependent will lose job and cant stay here . Is there way to escalate to HO as i did wrote to HO but didnt get any response.
Please suggest is it worth contacting local Councillor or again write to HO.

People with pending visa applications will benefit from Section 3C. So their visa will be extended automatically until a decision is given. Visa expiry hence is not important
