ILR:Period of absence gretaer than 180 days for dependnt

Post by anny26 » Tue Aug 10, 2021 1:34 pm

I am British national by Naturalisation and residing in UK since 2000, and intend to apply ILR for my spouse with Indian Residency. She would be completing 5 years this March2021.Her period of absence if more than 180 days for some medical grounds and have documents to testify that. Could i still apply for ILR or should go renewing her Settlement visa once more considering her absence period of more than 180 days.

Please suggest .

If she holds a spouse settlement visa under Appendix FM and FLR(M) extension, then there are NO absence limit.

Yes.

You also need to submit two years evidence of cohabitation in either joint names or addressed individually to you and your spouse. It needs to be items from 3 to 6 different sources, spread evenly for every 3 to 4 months.

ILR Set(M) Application query

Post by anny26 » Tue Aug 31, 2021 11:57 am

I would need to apply for ILR being a spouse of British citizen, currently holding dependent settlement visa and below my summary on dates and query please confirm if my understanding is correct.

Visa dates Summary
My first Visa issued:02-July-2016
Entry in UK:04-Aug-2016
Visa extention expiry:04-Mar-2022

Five-year completion date as per the first visa issued: Aug-2021
I have been out of country for around 2 years on and off due to Covid and medical treatments in India.

Though I checked before around leave of absence, having said that calculated No. of days I had been out came out to be good number unfortunately so asking below queries before I apply for ILR/VISA extension

Before are the queries and my response to ILR application, please confirm if they ok

Ques1: Though I meet all other criteria and have justification for all duration I have been out of country. Am eligible to apply for ILR from July-2021 to Mar2022 OR should apply another visa extension before Mar-22

Ques2: How long you have lived in UK? (Years and months)?
Ans: Can I still say 5 years as anyway I would be stating the reason for being out of UK

Ques 3: Do you or your partner currently receive any of these benefits?
Ans: My husband had been on furlough for Covid and still is , though we have good financial state to go through savings route, still should we state we have received benefits or can say no

Ques4: Do you own or rent your home?
Ans: House is my husbands name and mortgage goes from his account, can I still answer I Own.

Ques 5: How much mortgage do you pay each month?
Ans: As my husband pays the mortgage with house under his name , can I state that amount under me and mention that amount.

Ques 6: Evidence of monthly housing costs for the accommodation in the UK where you live or will live.
Ans: While we chose to apply using savings mode to apply ILR what documents should we use to support this monthly housing costs

Ques 7: Is the priority service resumed again on SET(M) ILR application as was suspended for Covid.

Please advise, so i can choose the proper route.
Many thx.

1. You have been told above that the family route has NO absence limit. You do NOT need to worry about being outside the UK. Why are you still asking this? You are already eligible for ILR

2. Say 5 years

3. Answer no

4. Yes you can

5. Yes you can

6. Evidence of paying the mortgage is enough

7. It is available. Note: indefinite-leave-to-remain/online-appli ... l#p2027486

Hi,
Apologies in advance as if my query is weird at this stage but this came as observation at last mminute to me:

Like as i mentioned i got married and joined my British husband in Aug2016.
Following permit of leave i got
1. In Aug2016
and the visa on passport said "Type: Spouse/CP , obsrv: Spouse/Partner. Work permitted

2.next renewal i had to do while i was in India and couldnt travel .this is from 05/2019 to 03 -2022
so visa on passport said"Type: D-PARTNER(STANDARD) , obsrv: Work permitted
Also "type of permit" on BRP also mentions only "LEAVE TO ENTER" UNLIKE previous BRP mentions spouse/partner

we didnt realise this difference earlier just was reading now on docs

Just wanted to confirm, would my second renewal from India cause any issue toward counting of 5 years ,while applying ILR thru SET(M) .I am just worried seeing this difference on passport and my BRP

Please advise.

hello ,
Sorry for coming back again with my queries, as i am progressing:

i have query regarding the 6 Letters to support cohabitation:

To set the context for my below queries,i had my Husbands sister living with us at our place until March2021.After that she moved out.
Now the council and the water bill show the joint name of Me , My husband and his sister.

1. Can i show these even when i am saying 'No' to in Application form for question :
"'Does anyone other than your partner and children Nolive with you at the property?"
.Or
i change to Yes and state that she is still living even though she moved out.

2.Also to have six letters of cohabitation is the below correct in terms of how i am spreading the documents over period of 2.5 yr
a) Water bill[This is addressed to in my, my husband and his sister]
15th Feb2019 to 30July2019
16th July2020 to Jan2021

b) Bank statement, while its monthly can i just randomly take one Monthly for year 2021, and one Monthly statement for year 2019

c)Coucil tax demand Notice[This is addressed to in my, my husband and his sister]with date issued of
a)March 2020
b)July2021

3. Also for the passports copies to be shared , do we need to have full scan of passport including blank pages or just First and Last.

Many many thanks for helping me on these,

There are NO specific rules on cohabitation evidence. Any evidence can be used. Provide whatever you can. Do not submit blank pages of passport it makes no sense

Many Thanks Zimba for supporting me throughout taht journey. With your support i finally uploaded my docs and booked appointment
Having done that, just wanted to check few things:
1/ Though i am carrying appointment booking along with hard copy of what docments uploaded, do i need to print the application form that i submitted also.
2. If i am carrying my Partners passport with me, does he necessarily need to go with me during biometric, as they vaildate the document
3. I am assuming i need not upload any evidence to support the duration i am out of country.

Please help in these last poitners and hopefully with my appointmnet booked for 19th Nov will get thru this
Thanks
Anjali

Hello,
i had a biometric appointment today in morning and just now i got mail from Homeoffice quoting:
====
""""Thank you for your recent application as a Spouse/Partner under Appendix FM.
You have submitted an application for Indefinite Leave to Remain (ILR) under the Spouse/Partner route of Appendix FM within the Immigration rules.

In order to qualify for ILR under Appendix FM you are required to have completed either at least 60 months under D-LTRP.1.1, or 120 months of leave under D-LTRP.1.2, as stated in section E-ILRP.1.3 of Appendix FM below:

E-ILRP.1.3. the applicant must, at the date of application, have completed a continuous period of either:
(a) at least 60 months in the UK with:
(i) leave to enter granted on the basis of entry clearance as a partner granted under paragraph D-ECP.1.1.; or
(ii) limited leave to remain as a partner granted under paragraph D-LTRP.1.1.; or
(iii) a combination of (i) and (ii);
or
(b) at least 120 months in the UK with:
(i) leave to enter granted on the basis of entry clearance as a partner granted under paragraph D-ECP.1.1. or D-ECP.1.2.; or
(ii) limited leave to remain as a partner granted under paragraph D-LTRP.1.1. or D-LTRP.1.2.; or
(iii) a combination of (i) and (ii).
However, we note from your immigration history that you have not completed enough time under the requisite route of Appendix FM to qualify for ILR.

===
They mentioned its highly unlikely to get ILR approved,

MY QUESTION IS DO I GIVE RELEVANT MEDICAL DOCUMENTS TO SUPPORT MY STAY OUT OF UK and take risk of ILR getting approved or just get to FLRM.
Please suggest
