ILR - Set M

My partner is South African, he's been in the UK for 4 years firstly on a Working/Holiday visa and lately on a spouses visa, we had our Civil Partnership in Dec 2007.

We applied in person for ILR last Wednesday (10th), they said they did not need to interview us and that all the documentation was in order, after waiting all day we were told that not all the checks were back and they are unable to make a decision and would write to us but this may take weeks.

What checks would they be waiting on? Would these be the same as for our COA and spouses visa? Nothing has changed for either of us since then, my partner hasn't left the UK in the last 2 years.

Would there be a chance it will be refused? We applied for the premium service to avoid the wait and worry then this happened.

If everything is in order, as you say, then there is no need to worry - even if it takes time. If the caseworker was unable to make a decision on your case on that very day, there must be a reason for it. But it doesn't necessarily mean that this delay = refusal.

You are asking members to "guess" reasons for the delay and probable reason(s) for potential refusal.

Be patient and you'll know the result in a few days time. No point in panicking without a reason! Or is there any?

There's no reason, just when we paid for the premium service we assumed (wrongly) that we'd know the same day. It's just the stress and worry waiting to hear.

Ask home office if everything is in order than why delay. If they can not decide on same day they must charge the normal ( by post ) fee. As you said they have charged premium fee than they should speed up checking stuff and decide asap.
