ILR - short of 1 month and 16 days

Hello Guys, Gurus, Moderators and Administrators

I got my Student Visa on !4th December 2004
I came to UK on 25th December 2004.
My 10 years are finishing on 25th December 2014.
My current leave is expiring on 11th October 2014.

So i am short of 2 months and 14 days to finish my 10 years.

I can apply on 27th of November 2014 which 28 days before 25th December 2014.

That reduces my gap to 1 month and 16 days.

I have only been out of country once during the whole stay. that was for 1 month and 18 days.

What should i do? any advice welcomed

You must apply under FLR(FP) before your leave expires, to preserve your section 3(C) rights, and then vary to ILR using Set(LR) on the 27th November.

but under what grounds should i apply? as i am not awaiting a decision or appealing one!

It will be under Private and family life provision on FLR(FP) and possibly vary to SET(LR)
