ILR SKILLED WORKER REDUNDANCY

Hi,

I hope you are well.

I am currently with a Skilled worker visa and spent 5 years with this visa and with the same employer. I have been made redundant and served with a lengthy notice period and my last day of working is July 2025. I am eligible to apply for ILR but my employer is not giving a letter explicitly mentioning I will be required for the employment for the foreseeable future. However, they agreed to write a letter (please see below). Would it be sufficient to obtain an ILR? Will the case worker be happy with that? I am a bit nervous and stressed due to this situation. Any advice would be really helpful!! 😊 thanks!!!

[Employer letter]

I can confirm that NAME has been employed by the employer as follows

Date employment started: Dec 2019
Current job title: xxxx
Employment: Full time (hours per week)

Name has been sponsored by the Employer for a Skilled worker visa under SOC XXXX. Current salary is £XXXX per annum which is over the minimum rate for SOC code and in line with the increments within the banding for the role.

This role has currently been served with the notice of redundancy however Name is still required for this job until July 2025 and the current salary will not be reduced before that.

As per the employer redundancy and redeployment policy the Employer is committed to identifying suitable alternative employment. However, the Employer cannot guarantee a redeployment opportunity will become available although every effort will be made to identify one. As part of Employer redeployment commitment, Name will be required for the continuous employment for the foreseeable future pending successful redeployment."

Well, by definition foreseeable future the predictable period. If there is a redundancy in the future then the don't need you for the foreseeable future but to the date of redundancy.

I guess you risk an expensive refusal. I would try to negotiate it as you have more then 6 months I guess they could remove your redundancy information from the letter. Though, if it is a higher education institution I guess they will refuse.

Thanks for your comments. I negotiated with HR unfortunately they couldn't include foreseeable future aspects but happy to remove redundancy details. Given the situation I am in this the best letter I got 😭..

Given I am required for until July and employer committed to redeploy me.. would that be considerable for the case worker to grant ILR?

better to find a new job and work there for one month to get salary shown in your bank statement

I have only seen two job-type case where no foreseeable future is mentioned but ILR is granted

University and NHS job

Thanks.. I work for the university. Given that I will be required for more than six months and University policy indicates that they committed to redeploy wherever possible. Do you think I would be fine? My line manager also writing supporting letter to highlight my good character and how I fit good within the organisation and as a permanent resident.

Those cases I mentioned did not highlight foreseeable future but detail the fixed term period

If you are a university researcher you can apply in parallel to your ILR for global talent endorsement. If you get this you may not need and employer letter at all. (Get one year global talent then apply immediately for ILR).

If you are an RA at the university then the university will always write you end of FTC date.
With these being said I have no experience with applying with a redundancy comment. I used to work for a university but when I applied for ILR I worked for a company.

If you have been made redundant you cannot get ILR

Good news.. I got my ILR. If anyone is similar to my situation, you can apply for ILR indicating redeployment policy as long as your application to visa is within early notice period.

Sorry, I won't be able to share the content due to sensitivity of the information. However, below are the things which I included and which I think benefited the visa success...

1. My job end date is July 2025.. (not very close)
2. Redeployment policy states that employer has legal obligation where they need to attempt redeploying employee who have been made redundant until the last of date of notice period. I submitted employer redundancy and redeployment policy.
3. Supporting letter from my line manager (which states my contribution to the employer and to the local community and my good character and how well I integrated with British culture)
4. Proof that indicated my social activities to demonstrate how well I integrated with the society
