ILR Spouse Visa when to apply

I have a question regarding ILR application as I'm hearing different information from different sources.
I entered the UK on the 24th August 2017 on the 5 year spouse visa route.
My current BRB is valid until 20 March 2023

Am I able to apply for ILR On 28th of July 2022 as it's 28 days before my enter UK?

OR

I Apply on 21st February 2023 which that is 28 days before my BRB expires.

In the total 5 years I have been out of the country for 317 days, will this effect my 5 years eg. would that be taken off the 5 years.
(Uk.gov has allowed 450 in total)

OR

(Uk.gov has allowed 450 in total) There is no absence limit for applicants on the spouse visa route
