Hi John.
Iam a new user. I just happen to google to get some info on wtc of my husband and happen to land in your website. and thankfully there were lot of information for me. Thank you for that. Now i would like to tell you the whole story in short.

Me and my husband both were INDIANS. My husband came here in work permit in the year 2003 and attained British citizenship in the year 2009. We were not married at that time and i was in INDIA. In the meantime my husband was sick in the year 2007 and was hospitalized for 4 months. So he applied for his NHS tax credit exemption card, Disablity living allowance and WTC and has been paid by the govt from then on.

We got married in INDIA in the year 2009 and i came to UK on March 2010 on spouse visa. Now he has been claiming the same amount even after my arrival. We both are now working. The total annual income of both of us combined would approximately come to £28,000 (somewhere around £14,000 per person) without tax being deducted. He has been claiming the same amount for WTC and has not included my name. He is not availing anyother benefits. I just came to know from the posts on this website that even if im not eliglible for public funds we need to apply jointly.

My question is, if we apply jointly, the amount my husband getting would get reduced just because our total income is £28,000. my understanding is that people with low income some where around £15,000 could benefit from WTC. Does this mean £15,000 per person or overall income of the family should be £15,000.

Will there be any problems when applying my ILR just because my husband has not applied jointly for WTC for the last year.

Thats benefit fraud. Your husband should let them know ASAP about your income.

I agree you need to make a joint claim. He may need to pay some of the tax credits back.
