ILR or Tier 1 Extension

ILR or Tier 1 Extension

Hi Guys,

I came to UK on HSMP on 15 Mar 2007, thought the visa was granted on 13 Dec 2006, but because of notice period in my previous job, I couldn't come to UK before march 2007. As I did my initial applciation before november 2006, I fall under HSMP judicial reveiw category.

The initial visa was for 2 years and I got my extension in Dec 2008 for 3 years. Now my current Tier1 visa stays till 13th dec 2011.

Though the recent changes from home office suggest that the intial time delay in entering in UK and entry clearance can be ignored considering its less than 3 month, I think I am bit unlucky as it goes just 2 days over 3 months in my case.

I think I need to apply for tier1 extention again, but looking into the website, I couldn't find the form for tier1 extension which I used for extension last time. That was very straight forward simple form to fill compare to what they have now. As I fall under HSMP judicial review category, thats the form I should be filling. Does anybody know the link from where that form can be downloaded.

And also I would like suggestion from senior members here if they think that I should give it a try to apply for ILR directly instead of going for one more extension.
(now the application fees are huge :( )

Under current directions, you should apply for an extension before your leave expires. However, if they haven't decided by the time you are eligible for ILR, then you may vary your application to ILR.

Better to apply for extension first and then apply for ILR soon after you receive your extension. Your will have peace of mind.

Ok... I see your point... do I need to pay the difference in fees for FLR and ILR when I vary the application or I need to pay the full fees for FLR.

The guidance form suggest the fee for extension will be 2000 for me (me + 2 dependent) if I apply by post where as this link on BIA website suggest, it will be 1000 GBP for us.

As for fees, follow the application form guidance.
