ILR Visa for Tier 2 ICT holder

I have been in UK for last 5 years and I am currently Tier 2 ICT visa holder. I was first granted work permit on 19th Jan 2006 however I arrived to UK on 19th March 2006 as work permit holder. I have applied for WP extention in Jan 2008 (first WP expired on 19th Jan 2008) and I was grated leave to remain till Jan 2011 (As per visa stemp from 11th Feb 2008 so there is gap of around 22 days in my visa stemp during which I was in UK waiting for approval for leave to remain). In Janauary 2011 I applied for Tier 2 ICT which is grated till Jan 2013 however as I will be completing 5 continuous years in March 2011 I want to apply for ILR.

I have been continusly in UK for last 5 years (since March 2006) with only 110 days out side UK on paid leaves or holidays. I have also working with same employer and employer is ready to provide me with letter stating they are ready to continue my service in UK.

As I have got Tier 2 ICT Visa based on rules changes after 6th April 2010 - does that create in problem with ILR application (provided I was in UK on Work Permit for almost 4 years 10 months)?

As I have gap in visa stemp during period of extention (19th Jan 2008 to 11th feb 2008) during which my application was with UK border agency and I was in UK waiting for approval from UK border agency - would it create any problem in ILR application?

Can some one please suggest if there can be any problem with the application?

In all probability you entered UK in 2006 on a WP (intra company transferee) authorisation, extended as WP (ICT) in 2008 and now a Tier 2 (ICT) migrant (currently). Your employer should be able to confirm all that for you.

In such case, you've been on ICT leave since 2006.

If you applied for extension (Jan 2008) before your leave expired, then there is no gap .. even though the gap in dates make you believe there is one.

Yes I was on ICT leave since 2006 - so does it create any problem in ILR application as my last leave granted is Tier 2 ICT post 6th April 2011.
