ILR when do i apply

Post by slim » Tue Jan 22, 2008 8:15 am

Hi Everyone,

I got my 2yr spousal Visa on 03-11-06 Valid till 03-11-08
Came into the country 11-11-06. I have not made up my mind yet if am going to be posting my application or going in person, but I might likely go in person. Meanwhile, I would like to get my dates right..

1. Which date based on the above info do I need to send my application by post? OR

2. At which date should I make an appointment to go in person?

I passed my life in uk test last year.

Thanks for your usual help

I believe that you may apply, either by special delivery post or in person, between 11/11/08 - [28 days (4 weeks)] and 03-11-08. i.e. between 14/10/08 and 03/11/08. Do read the requirements of Form SET(M) now.

Thanks for your quick response!
If I am getting this right, you mean for the special delivery to apply btw 14-10 and 03-11-08, while for the in person application on 03-11-08

I will read the links you provided as well.

Many Thanks
Slim

You may also make an in-person application between 14/10/08 and 03/11/08! Don't leave everything till the last day.

Hi,

I just need clarifiction on the above;

My Husband recieved his spouse via on the 6th Feb 2007 and entered the UK on the 24th February 2007 - i was under the impression that he can apply for his ILR on the 27th January 2009 (i.e 28 days before he entered the country) however according to the above post he should be able to apply 28 days before his spuse visa was granted i.e 9th January 2009?

Can you confirm if this is correct?

Application types > Completing application form SET(M) wrote:your two-year qualifying period started:
. when you received permission to stay as an unmarried or same-sex partner; or
. on the date when you arrived in the United Kingdom, if this was later than the date on which you were given a visa to come here in this category.
....
You must not send us your application more than 28 days before the end of your two-year qualifying period. If you do, we may refuse your application with no refund of the fee. However, you must make your application before your current permission to stay in the United Kingdom expires.
You are correct.

He may apply between 27 Jan 09 and 06 Feb 09.
