Hi guys,
I need urgent help. First of all following are my case details:
Tier 1 general visa approved on: 01-April-2009
PEO appointment for ILR on 12-March-2014
Now I would mention the problem:
On 27-June-2009 Received Disqualification from driving for 6 weeks and a £185 fine from magistrate court for over speeding on the motorway (SP 50).
On 20-Sep-2009 I received a fixed penalty notice (£60 fine) and 3 points from metropolitan police (no court involved) for driving not in accordance to my licence (LC 20).
Since 20-Sep-2009 till today I had no other traffic offences or court cases. I have also received my new driving licence with a clean counterpart.
Am I eligible to apply for ILR? or should I cancel my appointment and get a CRB check etc? I have mentioned them both on my SET (0) form but should they be ignored by the case worker as they took place 4 years ago.
Plz help...I am totally confused as I read on the guidance notes to case workers on general grounds (Sep 2013) for refusal the following:
Non-custodial sentences - disqualification from driving (pg 64)
If an applicant receives a disqualification from driving you must:
-refuse the application (where mandatory), or
-consider refusing the application (where discretionary).
plz experts....need your guidance.
