ILR - 4 years 10/11 months

I am on a tier 2 ICT visa.
My visa is valid from 6/01/2010 and ends on 25/12/2014. This is 4years 11-1/2 months.
Hence it is just short of 5 years.
Secondly though my visa was valid from 6/01/2010 , I entered Uk on 13/02/2010 I.e 5 weeks late.

So if I calculate my actual stay in UK it will come to 4 years 10-1/2 months or so.

In this case can I still apply for ILR or should I have to extend my Tier2 ICT and then once I complete 5 years stay , then apply for ILR?

In theory you can apply for ILR with no problems as you entered within 90 days.
Otherwise you could play it safe and apply for extension to give yourself some room and then apply for ILR when you've stayed for 5 years if that would make you happy

* 90 day concession (page22): The entry clearance stamp date is counted as the date of the start of the 5 year lawful residence not the Entry date in the UK itself, under the condition that the Tier 2 (ICT) migrant (granted before 6 APril 2010) enter within 90 days of the EC.

** 28 days - Please do not send us your application more than 28 days before you become eligible to apply. If you do, we may refuse your application with no refund of the application fee (if a fee is charged for your application type). However, you must make your application before your current permission to stay in the UK expires.
