Post by prisingh » Tue Oct 01, 2024 9:54 am

Hi all,
I am reaching on 10 year in uk in feb 25 and have below question for ILR.

1. How early can i apply for the ILR before the 10 years are completed ?
2. Is the super priority/priority avaialble for the ILR 10 year route ?
3. How long the current Indian passport validity is required for the ILR application ? My passport is expiring in june 25.
4. When can i apply for naturalisation and british passport after ILR in 10 year route ?
5. Kids born here .. so i assume it is direct british passport once we get ILR ?

Please let me know if anything else to be taken care of.
Thanks in advance .

Cheers

1. The earliest date of ILR eligibility is within 28 days from completing the 10 years.
The application date is not that critical: Applicants can benefit from the date of the ILR decision
2. Yes
3. It should be valid when applying online
4. This has nothing to do with your route to ILR. Normally you need to hold ILR for at least 12 months before applying to naturalise, unless you are married to a British citizen
5. No as such children are NOT British yet. UK-born children must be first registered as British when a parent settles, using form MN1. After they get registered as British, then they can get a passport

1. So i can apply 28 days before 10 years completion. Also is it travel date in country from where 10 years period starts, right.
3/4 As i need to be on 1 year ILR will need it to renew after ILR before june for sure .
5. So for children, no need for ILR applications. once we get our ILR then apply for registration.?
- does registration have super priority pls ? as i read that it may take 6 months :(
- after registration how soon can they apply for passport ? immediately ?

Thanks for responding.

As the children are UK born, once either one parent gets ILR, they can apply directly to register as British citizens.

Just make sure that they have private medical insurance for any period between the date their visa expires and the day of their registration certificate, as they will not be covered by the NHS for that period.

No. Neither registration or naturalisation have super priority. Neither of them are a part of the immigration pathway, which ends at ILR. Both are separate processes with different laws and requirements from immigration.

2. Do we have time lines for the registration pls ? Like how much time will it take.
3. Can we travel outside country while the ILR is done/ regsitration is applied ?

1. Your ILR does not affect their visa !
2. There is no specific timeline, every application is decided in its own timeframe
3. There is no travel restriction when it comes to nationality applications

This is the ILR forum :!:
Refer to the British citizenship forum for nationality applications: https://www.immigrationboards.com/viewforum.php?f=42

The traditional refrain to that question is "How long is a piece of string?". It takes as long as it takes. The Home Office's target is six months, but that can be extended indefinitely.
