ILR: 6 years in UK

ILR: 6 years in UK

Hi

I have been in the UK for 6 years now. First, I was on my work permit for 2 years (started Aug 2000). My wife had a dependant visa in 2001 and also got a job here in the UK. Before my work permit expired my wife applied for her own permit which was successfully granted. So now I am on a dependant visa since March 2003.

When can we apply for indefinite leave to remain?

I am afraid the answer is probably "no".
In order to qualify for ILR you must have been on Work Permit for 5 years yourself.
Or once your wife has completed 5 years on WP she will be able to claim ILR. You won't. You will only be able to apply for FLR(M) and then claim your ILR once you have been on it for 2 years.

Alternatively, if either of you completes 10 years of legal residence you will also be able to claim ILR but the time it currently takes to process that kind of application runs into years.

Sorry to sound disappointing... but still good luck!

If all his documents are in order applying on 10 year basis, i would say 3 hours.... not years.

Let me reiterate that I am a dependant of a work permit holder (my wife).

She will be able to apply for ILR after 5 years, right?

I have the same residency years as she has (presently - 3 years). Would it not mean that I will be part of that application because I am a dependant?
