ILR 4 OR 5 YRS

Dear,

I got my HSMP Approval in March 2006, VISA stamped in May 2006 and travelled to UK in June 2006.

As per Home Office directive; people joining the scheme before April 2006 can apply an ILR after 4 years? So, if I got the HSMP Approval Letter in March 2006; even though I got my VISA stamped in May 2006 and started my travel in May 2006; do I come in this category?

An email to the HO with ur exact timelines should give you better answer..

I would say since your approval latter is dated march 2006 you should fall in the category of 4 yr HSMP JR.

The judgment relates to the 'continuous residence' requirement for migrants who want to settle (or be given 'indefinite leave to remain') in the United Kingdom. It covers migrants who were sent a Highly Skilled Migrant Programme (HSMP) approval letter on the basis of applications made before 3 April 2006, and who obtained entry clearance or permission to stay in the United Kingdom (also called 'leave to remain') on the basis of that letter.

I would say, since you applied and received approval before April 2006 you will fall under 4 years category.Same happens this year when rules were about to change for PBS,people applied before 31March to escape rule to Master's Degree for Tier-1.Don't think your case will be any different from them (in terms of dates).

I think policy (JR) document clearly mentions who can apply for ILR based on 4 yr or 5 yr and on the basis of dates when you received HSMP approval letter. As you received your letter in March, you qualify for ILR after 4 years. Though situation could have been different if you had applied HSMP after the qualifying period for ILR was increased from four to five years on 03 April 2006.
