Immigrating to the US

Post by spring48 » Wed Aug 31, 2005 3:28 pm

I am an American married to a British Citizen living in the UK. I was wondering if anyone could tell me everything that I need to take to the US Embassy for our interview. I have the documents we need but I want to know if we would need anything else. Plus when they ask about how much money we made this year, Do they want what we made in the Uk? Very confusing.

it's possible you may need an affadavit of support, which i have heard that they don't tell you to bring. this is necessary if you don't expect your spouse to get a work permit immediately upon arrival. i'm not sure under what circumstances that is a problem.

I'm confused on this? Interview letter together with application package to include 1-130 has details of required docs. Submit these - no more no less.

As a USC you need to file taxes on worldwide income so this income needs to be shown to consular officer. Your spouse can co-sponsor the finance affidavit - use info from P60 and or tax returns if self employed. Payslips can be used to as can any cash in a bank. I believe your spouse would need to be listed in your filed taxes as a dependent.

What is your UK visa status. The consulate has been rejecting I-130's from applicant's whose sponsor does not hold ILR in the UK.

Well we went for the interview. I filled out the Affadavite of Support, What they don't tell you is that you can't use your earnings in the UK. So all we had to fill out was how much our assets were. We were well above the poverty line. So all is ok now. Just waiting for the house to be sold then we are off to the States.

Hi

My wife and I are at the start of the process and I was wondering about whether our assets alone would be accepted in the Affidavit of Support. Virtually all our assets are in the UK - is that the same for you? Do you have any advice you could give us - things you had to do that you didn't expect?

Referring to the earlier reply by Kayalami about applications being rejected by those without indefinite leave to remain in the UK - what was your situation there?

Many thanks

Hi,

Do you have any more info on this. The embassy website says nothing about this. My wife has limited leave at present and wont be able to change it to indefinite for another year (2 years after we married).

Thanks
