180 day rule for ILR and ILR dependents

Post by john_cena » Sun Apr 11, 2021 4:21 pm

Hello,

I hold ILR since early 2019 and my partner holds ILR dependent since late 2019. Now, we both are out of country for 4 months and it's likely that we won't be able to return to UK for 3 more months due to covid-19 pandemic. I have a couple of questions regarding the validity for both me and my partner's visa:

1. If we stay out of country for more than 180 days, is it going to impact my partner's route to ILR? Does 180 day rule apply for partner visas?
2. Does ILR have any time limit for which we can stay out of country?

Thanks

There is NO absence limit rule for spouse visa holders.

For the person holding ILR, if you are absent for 2 or more years, ILR is lost.

Thank you CR001,

Does this mean my partner will be eligible for ILR in late 2024 regardless of how many days out of country?

Yes, however obviously ILR requires UK residence. Your partner cannot live abroad for 5 years and expect to be successful with ilr.
