You should just use the time you entered as a spouse, stating tax credits and telling the caseworker you're waiting for the entitlement letter should suffice.

There is no minimum bank balance required but if you applying under ther old rules you have to meet the minimum income support for threshold , and letter of employment I would say say yes you need to provide proof of employment

Hi my brother wants to apply for leave to remain using parent route as he has a 2 month old baby boy. His tier 4 visa is about to expire and he wishes to stay on because of the child, unfortunately he is now separated from the mother of the baby who is British.

However they do state you have to meet the financial requirements and accommodation requirements and the rest but there is no definition of how much money i should have in my account and how long it must have been in my account for. My brother doesnt have a job at current but he has financial support from family and putting money in his account is not a problem.

Can anyone please tell how much money is required in order to pass the financial requirement for the parent route visa?

Thank you.

Student Finance

Post by chanjeewa.wb » Mon Jun 16, 2014 8:42 am

Dear All

Can someone advise me that if my step daughter would be eligible for student finance while she is on limited leave to remain?
My wife and step daughter are planning to come as a members of my family through my sponsorship and I understand they would get
30 months limited stay before extend further.

My stepdaughter has completed her high school in India and plan to go to university. I would like to know is she eligible to apply student finance while having limited stay?

Please help.

Hi Amber

thanks for helping all of us

I am in Pakistan and got recently married i am going to apply for visa my wife is on income support she is receiving Disability allowance for one child, carer allowance for child, she is also receiving child tax credit, child benefit and housing benefit.

carer allowance £61.25 per week
income support £40.25 per week
Disability (child's) £100.15 per week
child benefit £60.50 per week
child tax credit £ 301.75 per week
housing benefit £ 106 per week

total £ 670.05

she got 4 kids

so its 113.70 + 17.45+ 265.32= 396.47
and paying council tax £18 and house rent £106 per week so its £520.47

it means that she qualifies for adequate maintenance

The question i want to ask and which is blowing my mind

i have read in one of the thread that child tax credit child benefit and housing benefit is subject to public funds they can not be included in income and visa will be rejected am i right in this?
or
i can apply under adequate maintenance?

however
Annex FM Section FM 1.7: Financial Requirement 4.2 says that child tax credit ,housing benefit and child benefit are not permitted source of income

is that paragraph for both applying under adequate maintenance( due to disability or other allowances )and financial requirement under minimum income threshold

or is that for financial requirement under minimum income threshold 18600 only

please reply to lower down burden

Nabeel

Hi Amber,

I`m new to here, I`m stuck in the financial requirement. A quick question reg to 3.6. Meeting the financial requirement through
“adequate maintenance”. Can we use ESA? because I don't see ESA is being mention in the list, but I saw someone mention using ESA benefit in the forum ..

My partner is receiving ESA 110 per week which I think is not enough, can I use our join saving to add into the sum to meet the requirement? if so how much saving do I need?

I hope you can help me, any answer would be a bug help to me.

Thank you in advance.

They'd need DLA, IIDB or PIP or another qualifying benefit as well.

hi Amber,
i am going to apply for FLR(M) and my status as below
My wife on Carrier allowance which is 59.75 for his brother
she have her own house on her name but we are living on rented property
she have a joint account with her sister from morethan one year and balance is 33000(v will use this account as third party support)
I am on self employed and my calculated income after tax is 12000
we live on rented house which cost is 400/pcm
coucil tax is 108 pcm

so according to your old post calculation
my income 12000/12 =1000 per month and 250 per week
after joining income is 250+59.75 = 309.75 per week
rent and council tax per week is = 100+27= 127
so after deduct both= 309.75-127= 182.75
and couple require after deduction is = 113.70.

i want your opinion before application.
Thanks

Hi Amber,

Many Thanks for your utterly useful information about every matter via this platform.

I have three question regarding visa application for my wife from Pakistan.

1) I have been working for two employers for more than one year. One employer is paying annual gross salary of 18K and during last year in 4 months they paid me gross overtime of £250 each month, which makes my 12 month salary more than 18K. The second is based on hourly rate (Pay monthly) and I have been with them for more than three years. My last six month gross income is around 2k with them. My question is which category I fall? Category A or Category B? Do I need to provide them 12 months salary slips for both jobs or 6 month salary slips are enough?

2) Does this adequate maintenance applicable to me even after fulfilling the financial requirement of £18600? If it does then should my saving be more than £495 every month after paying accommodation from net salary?

3) I am living in two bedroom flat with my friend and the tenancy agreement and council tax is on both of us names. Should I change them to only my name and tell visa office I have let a room to my friend and the rest of the house will be in our use so it would fulfil the accommodation part, or it doesn't matter if the tenancy and council bills are under name of both of us?

I will be very grateful in advance for you answer in this regard.

Thanks

If you have to meet the Financial Requirement then adequate maintenance is not applicable and you should create a new thread for your questions.

Hi Amber,

Thanks for answering my first question. My second question is following.

I have been working for two employers for more than one year. One employer is paying annual gross salary of 18K and during the last year in 4 months they paid me gross overtime of £250 each month, which makes my 12 month salary 19K. The second job is based on hourly rate (Pay monthly) and I have been with them for more than three years. My last six month gross income is around 2k with them. My question is which category I fall? Category A or Category B? Do I need to provide them 12 months salary slips for both jobs or 6 month salary slips are enough?

Thanks

Hello,

On Section 7 B: Maintenance, FLR(M)

Anyone know the difference between Council Tax and Council Tax Reduction? Also, is ESA included on section 7B, is it income support?

Many Thanks
Stanley

Council tax is what you are liable to pay. Council tax reduction is the reduction (benefit).

ESA may be classed as income.

Thank you Amber. Below is what my fiancée is currently receiving as public funds (per month):

- ESA= 480
- DLA= 550
- Housing Benefit= 391 ( All her rent covered)
- Council Tax Reduction = 98 (All her council tax covered)

She also gets career allowance for whenever her carer coming, but all the money goes to the carers so I don't think I should include that.

My question is which section should I put ESA in? What should I put in " Do you or your sponsor, or both pay any rent or mortgage for your home? Should I put 391? I also have rent as we currently not living together but I am going to move in with her so I don't think I need to put my rent in.

How to answer secion 7. 6 should I include all her benefits even the housing benefits and council tax reduction are not what she receiving? Should I put 480+550+391+98?

Many Thanks
Stanley

You should set it out on a cover letter as per the beginning of this thread.
