Ok Hopefully Soon we will get something out of it..

Dear Casa, I went to a personal today who gives advice to community here on all such matters as a volunteer. He calculated all and said by the looks of it you were meeting it in 2014. But they only confirmation could be done if I ask An SAR from HO.

But home office said it takes 40+ days to send me the paper copy of my file.... Is there anyother way to find out in my previous visa will route they put me into?

As far as I am aware I was meeting all the criteria and maintenance was exempt due to carers allowance and the adaquate maintenance as of said by the person today was OK itself... I am hoping it would be 5 Years but

If any other way to confirm it from any HO department before 40 days?

I have only just seem the pm but I'm sorry to say that I know nothing about these calculations for a spouse visa. It was always amber who calculated these.

All I could do was look up the way to calcualte this

Thanks for your support... I am so glad to see such helpful and active people around here..

I been reading to much Immigration rules and requirements now a days and Similarly its making me too too too much confuse. BASICALLY I am trying to figure out what happened or should have happened in my previous application.

AS my Mrs was exempt for the threshold due to Carers allowance by the time of my previous application. She was receiving.

Carer Allowance: £61.35 (£245.40 P/M) (PAID Per Week)
Income Support: £ 13.17 (£52.62 P/M) (PAID PER WEEK)
Child Benefit: £190.40 (£47.10 P/W) (Per for 3 Kids Once a Month)
Tax Credits: £670.91 (£167.67 P/W) (Paid once per Month)
Housing Benefit: £369.24 (£92.31 P/W) (Paid Every 2 weeks )

TOTAL MRS EARNING P/M: £ 1528.57

Q: I was working as well by that time and Sent the 3 months Wage slips and 6 months bank statements.

Would they consider both of our Average Earning towards the adequate maintenance or Just her's?

If Both ..! Than who would they gonna calculate my weekly or Monthly Income? From my last payslip or they will take the Mean of the 3 months wages? Like Add the sums and divide by 3? AS I WAS JUST WORKING FOR 3 months by the time We made the application.


Because i heard someone saying that they will take six months into consideration and divide the the months salary to 6 months and GOD knows how..!!

CAN ANYONE GIVE ME THE SPECIFIED ANSWER THAT WHETHER THEY TAKE BOTH OF THE SALARIES IN CONSIDERATION?

AND HOW WOULD THEY CALCULATE MY AVERAGE WEEKLY INCOME? PLEASE

I AM SO SO CONFUSED PLEASE HELPPP

Can u please clarify..? Will they consider both of our incomes as by the time we both were in UK and i was working and she was on carers allowance as exempt from the Threshold..

It seems that both sources of income from applicant and partner may be included, provided both are legally in the UK.

Ask your employers to work out the gross annual salary/income. Divide by 52 to get the weekly income.
Immigration directorate instructions Annex F Chapter 8 Family Members - Maintenance And Accommodation wrote:5.3. Earnings from employment (all adequate maintenance applications under Appendix FM)

hi there please help me to find out if we will meet the adequate maintenance level or not

we are couple and have son 19 years ( not my son ,, is my wife son before me )

my wife receive 250 pounds weekly and she have DLA certificate

i dont work and my wife dont work but we live on the support

we dont pay rent because my wife receive ESA so we dont pay and the government pay for the rent


so will us be able to meet the adequate maintenance level ????

Dear all
I would appreciate it if anyone could help me, I the sponsor who has is a UK citizen, I have been working two jobs for nearly a year. I have been awarded PIP, on receipt of statutory sick pay from my first job £88.84 a week and from my second job I receive £589 after tax so estimated total monthly £944. I understand that after rent I would require £113.17 a week left over in order to satisfy "adequate maintenance" requirements. I have a child who is a UK passport holder I understand that each dependent requires £66.33 a week additional. But my child is a UK citizen so does this still apply? I would really appreciate it if anyone could give me clarification on regarding this.

Following the Upper Tribunal case of Ahmed [benefits; proof of receipt; evidence] Bangladesh [2013] UKUT 84 [IAC] and the Immigration directorate instructions Annex F Chapter 8 Family Members - Maintenance And Accommodation (click) (include a copy) at page 4, paragraph 5.2, staff considering an application for entry clearance, leave to remain, further leave to remain or indefinite leave to remain must demonstrate calculations detailing the actual financial position of the applicant/sponsor in all cases that fall for refusal using the following formula:

A – B ≥ C

A minus B is greater than or equal to C.

Where:

A is the projected NET income (after deduction of income tax and national insurance contributions);

B is what needs to be spent on accommodation (rent/mortgage and council tax); and

C is the amount of Income Support an equivalent British family of that size can receive.

For the purpose of income, benefit income can be used as income as per Immigration directorate instructions Annex F Chapter 8 Family Members - Maintenance And Accommodation, paragraph 5.2(a). No benefit income is said to be excluded in the Immigration directorate instructions.

Key rates 2014/15 should be:

Income support rate for a:
couple £113.70 per week/£492.70 per calendar month
single person over 25: £72.40 per week/£313.73 per calendar month
each dependent child: £66.33 per week/£287.43 per calendar month
income support family premium: £17.45 per week/£75.62 per calendar month.

e.g. using these calculations a couple with two children would need to show:

£113.70 for couple
£17.45 family premium
£66.33 x 2, for each dependant child

=£263.81 per week left over after deducting rent/mortgage and council tax.

A couple with no children would need to show £113.70 per week remaining after rent/mortgage and council tax is deducted.

Following the Upper Tribunal case of Ahmed [benefits; proof of receipt; evidence] Bangladesh [2013] UKUT 84 [IAC] and the Immigration directorate instructions Annex F Chapter 8 Family Members - Maintenance And Accommodation (click) (include a copy) at page 4, paragraph 5.2, staff considering an application for entry clearance, leave to remain, further leave to remain or indefinite leave to remain must demonstrate calculations detailing the actual financial position of the applicant/sponsor in all cases that fall for refusal using the following formula:

A – B ≥ C

A minus B is greater than or equal to C.

Where:

A is the projected NET income (after deduction of income tax and national insurance contributions);

B is what needs to be spent on accommodation (rent/mortgage and council tax); and

C is the amount of Income Support an equivalent British family of that size can receive.

For the purpose of income, benefit income can be used as income as per Immigration directorate instructions Annex F Chapter 8 Family Members - Maintenance And Accommodation, paragraph 5.2(a). No benefit income is said to be excluded in the Immigration directorate instructions.

Key rates 2014/15 should be:

Income support rate for a:
couple £113.70 per week/£492.70 per calendar month
single person over 25: £72.40 per week/£313.73 per calendar month
each dependent child: £66.33 per week/£287.43 per calendar month
income support family premium: £17.45 per week/£75.62 per calendar month.

e.g. using these calculations a couple with two children would need to show:

£113.70 for couple
£17.45 family premium
£66.33 x 2, for each dependant child

=£263.81 per week left over after deducting rent/mortgage and council tax.

A couple with no children would need to show £113.70 per week remaining after rent/mortgage and council tax is deducted.
