Salaam Softlogic,

Mubarak on getting your passport back. My wife submitted her passport about 5 weeks ago in ISL but we still have not heard anything. Did you send any e-mails to BHC, and if so what did you request/write if you dont mind. This will help me a lot.

Jazak Allah

Post by Waqar1 » Sat Sep 12, 2009 3:35 am

Salam to all
i was reading post on this fourm from month i have re submitt my passport after settlement appeal at 6th july but no news yet.I have email to high commision and my wife done through local MP but same reply from visa section passport is with case work section and will be seen on turn. And can't give time frame. I just advice people whos patner is brtisih citizen they can make complaint through local MP it will help all others as well who have similar cases.Complaint procedure you can find on this link.
http://www.ukvisas.gov.uk/en/aboutus/en ... complaints
So all the british citizen you can use your rights and bring the matter in front of top authorties as it is tottaly unfair that after allowed appeals they take that much time.

Student visa appeal allowed waiting for visa stamp.

Post by freedomofspeech » Sat Sep 12, 2009 11:45 am

Well, I think we need to wait for six weeks. Especially for student visa cases. Thanks to God that my commencement date is 26th of October otherwise, I would definitely miss my classes.

Post by freedomofspeech » Sat Sep 12, 2009 11:58 am

My catagory is student visa. I got call in letter on 13 of july and I submitted my passport on 11 August 2009. Since then I m just waiting and counting every single day, lol.

However, I remember being told that, many students took their passport within 1 month , but I donnnu wheather they were right or wrong?
Whatever, we all are waiting for return of our passports and I believe inshallah we will get our passport with visa.

If anyone receive phone call do let us know so that we could be able to calculate our time.

Still waiting for Passport Call!

Post by VeryFrustrated » Sat Sep 12, 2009 1:36 pm

Hey everyone,

can anyone give me an indication as to how long it takes for the BHC to issue a call or send a letter regarding the passport submission appointment. My uncle has won a settlement appeal for his wife and two children and the hearing was at Bradford AIT on 3rd July. Since then, his wife has only received one letter in the post around 15th july to say that their appeal has been approved but no other information was given. I rang AIT after that who said that we should now wait for a letter of appointment from Home office (I think they meant BHC in ISB), they also said that this could take upto 6 weeks. Its been 10 weeks now but no response as yet. We are bit concerned now because there is no rush as such but i am thinking we should atleast get a call to submit my aunts' passport etc. By the looks of it she will have to submit a new TB xray thing again??? What other documents will we have to submit once the appointment is sent to us and do they check all the details again or is it just a matter of passports being stamped??

anyone from past experince, please help!

Thanks

student visa appeal allowed waiting for visa stamp

Post by freedomofspeech » Sat Sep 12, 2009 7:25 pm

Well, Your uncle has just won an appeal, all you have to do is to just wait for 4-6 weeks in order to get Call in Letter.

Therefore, I recommand you just forget about it because if you think over and over again your frustration will likely to increase. Inshallah you will receive your calling letter soon. For more information you may visit UK Border Agency Website.

As far as TB screening is concerened, yes if it is expired you need a new one but remember dont take TB screening right now unless you receive Call In Letter by British High Commission, Islamabad.

Bro, I have been waiting student visa stamping for last 5 weeks and still got no reply by BHC Islamabad. :(

Pray for us.

@ veryfrustrated

I think they dont work really with timescales as every one has different experience.I won the appeal case on the 2nd of march. Then within a week my wife received a letter confirming that the appeal was allowed.Than the Home office has 28 days to appeal against the decision but in the last week that was remaining she got a letter from bhc islamabad to submit her passport.
Damn to the BHC Islamabad!!!

Student Visa appeal allowed

Post by freedomofspeech » Sun Sep 13, 2009 10:32 am

Yes you are right they are not working with their given timscales. This is totally unfair as I have sent an email to BHC Islamabad in order to know my passport status, but not sure exactly wheather they will reply me or not?

Dulharaja, If you are in the UK. Wouldnt it be better if you make a complain against BHC Islamabad? what do you say about it?

Hello every one,
Sorry for my late reply, actually I was busy with planning stuff so could not get online. I will answer all o you one by one but general words are that plz just be patient now. I have nth eared any one getting refused after allowed appeal (but they can in exceptional circumstances) so INSHALLAH every one who’s appeal is allowed he/she will get it. For instance my appeal was allowed in mid of January 2009 and I got my visa on 9th of September. I hope it will help.

@ammalik,
Thank you very much for Mubarak, well now a day’s BHC Islamabad are taking long coz of student session and also rush due to holidays season as many people apply to visit UK. Please be patient and give them 2 to 3 months minimum to process your case. Since last 5 months I have only seen a one case in which the applicant got his passport back after one month else all are getting after 3 months. now the rule of the game is just patience. You can send email asking about status of your case whenever you want and most of the time they do reply although send same reply to everyone.

@ Waqar1
Yeah its true I also have heard that contacting MP does help and one should contact MP if 12 working weeks are passed else they will reply the same to MP as well.

@FreedomOfSpeach,
I [personally think that Students should not worry at all and INSHALLAH all will get their passport back very soon. In case some ones classes already started they should get extension letter from college and university and Courier it to the BHC ASAP. Now a day’s students are at high priority in BHC that’s what they say. Go on sending them emails and INSHALLAH u will hear very soon.

@VeryFrustrated
BHC take around 4 to 6 weeks to issue a calling letter after you get determination letter. In case that time is passed then please send courier/email to BHC with the copy of determination letter asking them to send you calling letter. I did it and it worked with me minimum. Also Take TB certificate just 1 or 2 days before your passport submission.

Thanks and best regards,
Kash

Student Visa appeal allowed

Post by freedomofspeech » Mon Sep 14, 2009 6:45 am

Softlogic:-

I am grateful to you for providing very useful information to us. Softlogic, now a days it is really hard to get an appointment, as my couple of friends have been trying to make a call to the Gerrys FedEx over the past 3 days and got no response at all. We never expected Brits High Commission would be like that. Furthermore, Those people who have submitted their passports 3-4 months back they havent heard anything which is totally injustice and unfair. :? .

I think we need to make a complain agianst BHC for not working on specified timescale  then there would be some chances of getting prompt reply.

It seems to me that, BHC understood Pakistani people nature lol, By this I mean that, ( standing in long queues to get subsidised atta and sugar, criminial pending cases in Courts, waiting for taking new passports , waiting for CNICs etc etc ). Whatever, lets see whats gonna happen ?

Best of Luck 8)

DAWN

Post by scholarshk » Mon Sep 14, 2009 11:07 am

Hello Everyone,

This Sunday DAWN Letter to the Editor, a daughter's mother, helpless like all of us wrote.

http://www.dawn.com/wps/wcm/connect/daw ... -uk-hc-399

I think, we ALL should e-mail letters@dawn.com with reference to this letter and write that we are waiting since this this months.

When they'll get so many e-mails, BHC would definitely take action (if its not completely shameless).

Regards,

SHK

1st time when it was rejected the showed up,but second time when i did a fresh applixcation it got rejected again.I didnt bother to take an sollicitor because i had paid nearly a 1000 or more already on that before. My uncle who is a pharmacist,he represented my case an won,The judge told me at the hearing that home office were given twice a time to submit their pain, but they didnt bother ,at the hearing they didnt even show up.I Live in birmingham and my heasring was all the way in New Castle. The judge still wanted to see my evidence,he looked at it and said he was lost he couldnt see the problem,so he allowed my appeal. He did it rite way when i was there.

Its not always necessary to have an swine like a sollicitor. They love their fees and dont really give a damn about ur case.

(i got part of my paid fees back, how is n other story  )

O thats great to know that, you work in famous shopping centre Bullring. Please let me know the situation of Birmingham I mean, protest of English Defence League against extremist muslims and what is the condition right now :?:

I think Birmingham is no longer safe for International students especially pakistani students. :( Nevertheless, just pray for me, 6 weeks have passed since I submitted my passport after an allowed appeal ( student visa ).

Many thanks for the replies, but could you please suggest something on following? Me and esp my wife are really worried now

1) Somebody has told us if your visa is rejected then you can only apply again after six months?

2) Shall i apply both my mother-in-law and my mother together or one at a time?

3) I'm providing following documents for my father-in-law, are they enough?
- father-in-law bank statement (though he don't have sufficient funds in it, is it ok?)
- his house bills
- his passport n nic
- affidavit saying that mother-in-law is his wife, they've school going kids and she'll definitely come back etc
- Bay form
- Father-in-law marriage certificate

MAny Thanks
Faraz
Hi guys,

They've again rejected my mother-in-law visa with the same reason as of my previous visa application. This is really frustrating especially my wife is 8+ months pregnant and she's really stressed and worried after this decision which is not good for her at all but i can't do anything :(

Just to give you background initially they rejected with the reason that my mother-in-law hasn't provided anything about her family and financial situation then we applied again with everything like property documents, tax document, family tree, family NIC/bay forms etc but stupidly they've again given the same reason that you haven't proved that you've any dependent back in Pakistan etc. which doesn't make any sense.

I really don't know what can i do here as my wife due date is 24th of next month which is not far away! :(

Any suggestions????

Student Visa appeal allowed

Post by freedomofspeech » Tue Sep 15, 2009 1:35 pm

Dear Farazfastian:-

I can understand your pain, but I am afriad I can not tell you about your case because I am not well familiar with Settlement visas. As far as I can tell you should lodge an appeal at AIT, London or if you want to re-apply I would suggest you to consult a solicitor first.

However, I think DulhaRaja, has same case and he won an appeal. Therefore, he might tell you better than me and i hope you feel better.
:)

Thank you.

Wish you all the best

All i need is suggestion from you people based on your experience that is it worth going in to all this provided my wife is due on 24th Oct and it could be before that as well. So i'm talking about getting visa stamped in less than a month time based on current examples i don't think it looks practical at all.

Now i'm applying for my mother next week with the fresh application and this time i won't even mention about my wife pregnancy all i'll say that i'm inviting my mom to visit me.

To be honest i don't think they'll grant visa for my mom either based on reason they've given on my mother-in-law visa rejection.

We supplied following evidence to prove that my mother-in-law won't stay more than six weeks:

- my father-in-law tax document
- my father-in-law statement explaining the full family tree including dependent children
- property documents
- nic/passport and bay forms of all family
- utillity bills

But still they've said that we cannot prove that you've any family, dependent or any property in Pakistan and we do think you won't go back.
I don't know what they need to prove that, the only other thing i can think of is marriage certificate.

Hi faraz...i know its frustrated.I spend loads of money on sollicitors and barristers. They just charge you to fill in that stupid form to lodge an appeal by nearly 200!!!You can do it by ur self.

I know 3 ppl who got their case rejected,
1 a friend got rejected for his parents...he represent his case by himself and got the decission allowed.

2nd is an taxidriver who has only 5 yr education at school...even he won his case with support of his wife.He went to the hearing and show all the evidence he had.

3rd is mine friend as wel he won it too for his mom and she recently visited uk and went back.

No need for a sollicitor they just rip u off!!

I suggest an MP.Someone had advised me that too and i have been recently in touch with an local MP.If u require some help just pm me ...

Dulheraja :p
