Court Hearing Update 1

Guys sorry for the late reply just been very busy today and yesterday. However I can confirm the hearing went really well the Home office Rep did turn up and our hearing start approx 1.30PM & finished about 2.15PM but 10-15 minutes was wasted on paperwork being going back and forth to the judge as Home Office had not provided all the documents bundle to the judge so my lawyer had to provide them and also give them to the Home Office as well.

To be honest I was not asked a lot of questions just judge asked me one minor question and the HO lady rep asked me few questions and then never argued the point. My employer was called in and she was asked 2-3 questions and then the judge asked him one question and that was about it and exact same with landlady she was asked by HO only and that was it and I was so shocked that HO never argued any point with my lawyer as she was satisfied as if this was not the case then she would have wanted more information.

From what I see everything went well as my lawyer did not have to argue any point to the judge and the judge really did not doubt anything as she would have wanted clarification but that did not happen either so HO really did not come prepared as my lawyer twice had to give her some documents from the appeal bundle at time of appeal which she had documents missing from and she was happy with them. To be honest she did not fight any point just clarified it.

I will update more in a bit as this is basically a short summary and any questions please do welcome.

Anyway what do other guys think who have went through the process.

Our judge was a very nice lady and she is actually a lecturer/professor as well so she is fully aware of what is happening and was my lawyers professor at University some 10 years ago so my lawyer knew her from previous duties but she was so so nice that she just told us take it easy and just sit down and answer no need to stand up as normally heard you need to stand up and give a statement or account of things.

Anyway HO never argued any answers from my witnesses or myself and my lawyer had argued nothing or cross questioned anything so on this end it went really well as I was thinking there will be a very tough fight will be put up.

At the end the judge asked both parties my lawyer & HO why we should and why should not allow the appeal. HO Rep lady replied I think I will stick to the ECM decision as it was not reviewed and that is all she said as I think she did not have a leg to stand on and did not want to get embarrassed and admit defeat in front of everyone so just basically blamed the ECM for not properly looking at files but will stick to there decision and that is all she stated in the closing argument.

When my lawyer was asked he read the ECO Refusal and then read each sentence of the refusal and pointed to the judged as you can see Mam that Mr Ali has provided all documentary evidence for his job, job offer and all proof he is residing at the premises in Glasgow so we think that the ECO has made a wrong decision as all documents are put in front and Mr Ali + the employer & landlady has turned up clarifying all things and he took approx 5-10 minutes an the judge basically said thanks to everyone.

Anyway my lawyer stated that getting your landlady and employer into court was just too much for HO as he did state if HO did not believe or judge had doubts they would have asked them more questions and would have doubted them but HO lady was satisfied but she just stated I will just stick to ECM decision but no reason was given as she had nothing to say more than this.

It sounds like it went really well Haroon. Just hope the Judge sees sense and gives you a right and just decision.

To tell the truth these HO reps don't really have a leg to stand on but they will attempt to defend their indefensible ground without providing any rational, logical or factual argument. The government is desperate to keep immi numbers down so this is the biggest problem we face.

Yes from my lawyer as well he did say just do not see it not being allowed as that would be silly but do not get excited as wait for outcome but we were not questioned on anything on judge just some general questions.

When the case was closed the judge said I have enough evidence now to make a decision but she did state this to everyone that please remember if I do allow the appeal HO still has 28 days to appeal the decision. What do you think maybe she is hinting that she is going to allow the decision as I spoke to someone else as well and she had advise judge would not say that if she was not going to allow it.

To be honest HO did not provide any reason to the judge to say why appeal should not be allowed as she stated just stick to the ECM decision then what did she come to do at court waste everyone's time....

May I ask what do you think of all the above ordeal what are my chances or if anyone has been through the process your comments appreciated.

I am confident but everyone has stated wait till you get it in Black & White as judge was not questioning anything and she must have not doubted the information.

Today I got Notice of Pending Appeal by post, ECO has 19 weeks to review and the date given is 9th January 2014.

Been successful the judge will have no choice
But to allow your appeal as you've managed
To resolve all points of refusal
I've also got my appeal coming up next year
But I haven't hired any lawyer I'm going by myself
Can I ask you how did you manage to get your
Court date early did you write to them
Also wot did you include in your appeal bundle
Any help will be appreciated thanks

My husbands appeal was recently allowed (4 weeks ago) and he is now currently awaiting the call letter for him to submit his passport.

Would it be possible to contact / email Islamabad / Dubai and ask them to email me a copy of the letter so that my husband can print it off as he lives in a small village and there can be problems with post. If so what is the email address or telephone number I need to contact?

Ok guys, so my hearing was earlier today.

I really can't tell how it went. It started off really bad. As soon as I confirmed my name, address etc the Judge started saying the applicant did the English test after decision so I can't take that in to account.

The judge actually asked my solicitor to speak more about article 8 (seemed like she wanted him to convince her) and as my solicitor argued the article 8 point and mentioned my daughter it did seem to get better but I really don't know what to think. Judge smiled at me as she dismissed us but I'm probably just reading into it too much.

Now just praying and waiting for the determination letter...

Hi there,

Regarding the details in regards to expedition request I have gave them on earlier posts and you can check on them and see but you must have very valid reasons or a solid expedition request and put in a proper 1000+ word explanation as to why the expedition should be granted.....

Appeal Bundle I had included more documents to show I am working, lease, P60, Letter from HMRC, Phone Bills -- Basically I put in 30 pages of different documents to back up everything to say I am working and all that.

It depends how you go about things but my lawyer prepared all the work and he had copies of all that I just gave him the papers.

Just make sure you have a solid witness statement stating everything and why the ECO refused and why you should be granted the visa.

Em that is weird I was only asked one question by my judge and few things from the Home Office as I had thought we would need to use the Article 8 Human Rights as well. Maybe the judge was not nice or something but however did the Home Office not ask you any questions.

Also may I ask how long you were in for.

Do not worry as she failed the English Test but obviously she had to do it again so it does not make sense if she can not take that into account as it has to be taken into account.

Also you have a daughter and they can not stop the right to family life. Maybe you had one of them judges, anyway did the judge not mention about the appeal being allowed or anything.

Hope to hear back soon from yourself.

It lasted around 15 minutes. The home office rep did ask me one question.

The Judge cannot allow the appeal on immigration rules as my wife did the test after being rejected, so it's new evidence. My only hope is article 8. She just said I will make a decision this afternoon and you will receive a letter in 2 weeks.

Hi Guys ,

Asking on behalf of my cousin...

She applied as applicant on 10th january 2013 and was refused with many points on February 25th...

She sent appeal as well as review...

she got a letter addressed to herself and ECO , which tells eco to come forward with everything before 8/October/2013 , so court can give a hearing that...

any idea when should she expect a hearing date if her first court date is 8 October 2013...

I think at the moment she has got a Notice Of Pending Appeal which is IA10 which has given a date normally for 19 weeks.

After this she will get a hearing date which now a days is taking 4-6 months as well.

Maybe the decision might get overturned before this but if not then she will get a hearing date after 4 weeks since that date has passed.

Emm I was in for 30-45 minutes but judge did not ask me questions or my lawyer only one for me and some for my witnesses I took with me. So not sure but I had put tons of things after application as there was a lot of documents dated for 2012 that were after my application.

Anyway judge said she will revert back to me within 2 weeks with a decision so anyway let's see what they say and I think you should get the visa as we never had to do any defending.

I hope to get update from yourself soon.
