We received the same as ShaeenZaid,

Trbibunal advised hearing date for Jan-2014 (deadline was end of Nov 2013) but we have not been advised of reasons for decision being upheld despite further supporting documentation we sent across to them.

I spoke to someone at Contact centre who advised ECM does not always advise why when they return pack, many cases their statement just says decision has been upheld.

I have just noted there are 2-3 applicants who have got there documents back before the review dates and it looks like ECM have upheld the decision.

I think you should check the letter BHC send back with the file as they will give a decision such as either uphelding the decision or not checking the file due to the ECM being short of staff.

Anyway hope all goes well and the appeals get overturned.

That is not bad too be honest as normally court dates are going into March/April and ahead.

Your lucky but why did they send your file back before the deadline date.

Yeah same as me..
There's no reason just says the appeal will be heard in January.
I hope we all get them overturned before the court date in shaa Allah & our spouses are with us for new year :)

Its been 3 weeks since our appeal ECM deadline and still waiting for a court date to be set

I am in the same boat guys, I really hope that you all get your decisions in your favour.

My court hearing has arrived and am trying my best to get a early court hearing or get decision overturned !

Oh I am very sorry to hear that.

I would advise you to put a new application rather than appealing to upper tribunal.
Best option is to submit new application it will be expensive but much better than all the hassle.

Home Office Glasgow NO CLUE WHATSOEVER!

Now I am really annoyed today as I call the Home Office Glasgow and have just had all sorts of conflicting information from them since the appeal has been allowed.

1st Call (2-3 Weeks Ago) - We have the appeal and can confirm it has been allowed and will process shortly.

2nd Call (1-2 Weeks Ago) - We can confirm that we will not be appealing against the judges decision and will be forwarding your determination to the relevant embassy and you shall get call in letter very soon.

3rd Call (Today) - I am sorry to say but we have not sent the determination to Islamabad as we do not have it but I will deal with it very quickly.

I AM TOTALLY ANNOYED AT THIS CARRY ON BY HOME OFFICE THEY HAVE GAVE ME SO MANY CONFLICTING INFORMATION AS THOUGHT WOULD HAVE HAD CALL IN LETTER NOW AS I EMAILED BHC AS WELL BUT THEY NEVER GOT BACK EITHER.

You should fax them the determination letter. That is what I did, then they wont have any excuse for not getting it.

Hi everyone

My wife has sent her passport to BHC Islamabad for the visa after our appeal was allowed. Can anyone please give me an indication on how long is it taking these days for the visa processing at Islamabad on allowed appeal applications.

did you get your decision overturned or went through the appeal process ?

if its appeal process, did you send in evidence before hand or you took it with you ?

I have heard that you get passport back next day or very quickly once they are submitted for stamping ! So don't have to wait for long iA!

The appeal was allowed after the whole appeal process. We received the call letter from BHC Islamabad requesting to submit the passport which we did yesterday.

Did you get instant decision on court hearing ? and how long you waited to get a call letter from the court hearing date ?, Mine court hearing is in Early January and am trying pull it before Christmas !

My Time lline:

Spouse Settlement application made: 10 October 2012
Refused: 30 November 2012
Appeal made: 11 December 2012
Initial Deadline: 16 May 2013
Subsequent deadline: 16 July 2013
Appeal allowed: 10 September 2013
Paper appeal so no court hearing date.
Call Letter received: 1 October 2013
Passport submitted: 3 October 2013

As long as you meet financial requirement i.e produce required docs to proof of salaried\self employment with at least "6 Months" pay slips bank statement or Tax certificate that shows your net income is above 18600 you guys should not worry.

Obviously if you don't meet the required criteria as per guidance notes then am afraird there is no let off unless you get lucky :) - Allah knows best !

I was unlucky as I started my own business and it was too new to produce tax certificates etc and I got refused due to that although I believed I ticked all the boxes ... oh well .. tough but that's how it is am afraid.

Hi,

The court case will focus on your specific reasons for refusal. The questions will centre on how your spouse meets the financial requirement and what evidence he/she has to back that up.

When I went to some appeal hearings, one of the ones that I attended, the HO representative delved into the sponsors finances and employment status. There were a few generic questions to start of (who do you work for, how long) but then they were all specific. Questions asked of Munashak would mostly be specific to Munashak's sponsor's situation.

Bottom line is, if your sponsor is unable to meet the financial requirement or simply does not have the proof (as stipulated by the visa rules) then it will be unlikely that a visa will be granted. Unfortunately there is very limited possibility of a case going through on HR gounds. I believe Munashak's spouse argued on HR grounds but ultimately the appeal was rejected.

Sorry to sound negative but if your house is in order (i.e., you have the required evidence to prove you satisfy the conditions) then legally you will be fine and will get a decision in your favour.

Hey Ronz when was ur ECM deadline and how long after did you receive your court date
My husbands ECM deadline was 10th September but still we are waiting for our court date...
