Spouse visa requirement

Post by Yasmin123 » Mon May 23, 2022 9:55 am

Hi,

Hope you are all well. I have couple of questions

1. I am going to marry next month and I want to bring my wife here. I am the owner of ltd company for last 8 years. What else do I need to show apart from my 6 months wages slips which I withdraw from my company. Today I have deposited £16000 into my personal account and also start withdraw wages for this month which will meet £18,600. What else do I need in terms of finance?

2. Do I need to show WhatsApp messages or shall pictures or video of wedding would be enough.

3. Does she has to pass A1 EILTS Test?

4. Can you suggest me course of action which will help me if I adopt over there for immigration purpose when I am marrying in Pakistan. Like (Nikah Nama) marriage certificate should be in English etc. what other procedures if I adopt will be helpful for immigration purpose?

Thanks

£18,600 per annum, savings don't count if you just deposit, more on savings below
wage slips 6 months, with bank statements for 6 months

Savings £62,500 minimum for 6 months, source of funds

Yes A1 test, search online English language require for visa, gov.uk have test centres and tests accepted

whatsapp messages, wedding pics, invite cards for wedding

Original marriage cert in your country, and then English translation can be done here with a reputable firm
or from local council in PK tehsil mufti
If you have nadra i think it has both english and urdu so you will be fine

note: ltd company application, needs lots of documents, if you can go savings route

You need to spend time and read previous forum posts to gain insight.

Today I have deposited £16000 into my personal account
So that you are aware, the first £16000 savings is not considered for meeting the financial requirement.

You also cannot combine savings with self employment or employment as a director or employee of a specified limited company. See page 44 in the link below.

Thanks mavaas11 & CR001

I know Being company director it is long winded process but I could sum it up as below would you think that would be acceptable for HO

1. My last year P60 was £18,900 (21/22). and in this year from May 22 on ward I planned to withdraw £2000 as wages and then I will apply in six months time. Do you think one and half years wages would be sufficient to show that my income is more that £18,600 a year for HO and acceptable.

2. I can attached my 2 years company accounts submitted into companies house. Does it necessary that company must be in profit.

I don't think anything else besides the above. if that is hard to show finance being as director then another route in my head is to become employee of someone as that seems pretty easy route and less hustle.

What's your opinion?

Thanks CR001 as you helped me in my business visa and later in naturalization as well. It looks like we people will never be able to get out of this process as one thing sorted another jump up.

Hi,

Can someone help please. I have transferred my investment of 60K from business to personal account. I have remaining saving which makes up more than 62,500 to apply under category D saving accounts. As far as my investment in business is concerned that has already been proven while I was applying for business visa. Do I need to proof that again as it goes way back 2014? Or simply accountant letter or submitted annual accounts in company house will be sufficient in this regards?

Thanks

Business investment as a cash saving £62,500

Post by Yasmin123 » Fri Dec 30, 2022 5:22 pm

Hi,

I have quick question.

If I transfer my investment £62,00 from business to my personal account for spouse visa in order to show my cash saving. Does it has any tax implications?

Thanks

You will be required to prove the source of funds for a visa.

Note also that you will need to find a tax forum to ask about tax issues. This has nothing to do with immigration.

Thanks, but that has been already proved in 2014 to UKVI because of which I got my business visa in 2014. How can I proof investment 8 years back?

2014 visa stuff has absolutely nothing to do with applying for a spouse visa now. You still have to prove source of funds for a spouse visa. I did not say you have to prove investment of funds I said you have to prove Source of funds. So if you transfer from business account (which technically is rhe businesses money not yours), ukvi will expect to see where you got the money from.

Thanks, can submitted accounts in HMRC be as proof of source of fund? That can easily be accessed from company house website and I can also submit accountant letter in this regards?

Ukvi would expect to see evidence of bank transfer from both send and receive banks.

Be careful though, if you have a Ltd company and have simply taken the money out to your own personal account as a straight transfer, as a Ltd company, the money is not yours, it belongs to the company.

That's more of an accounting issue - a director can take money out as salary, dividends or from a "loan account" which is repayable.

Husband's timeline - overstayer 11 yrs
08/16 - FLR (FP) Partner, refused 02/18, 03/18 - JR permission refused with merit
08/18 - FLR FP (Partner) PSC - Approved
07/20 - FLR FP to FLR M Switch - Approved, 03/23 FLR M Ext Approved.

Super priority service

Post by Yasmin123 » Sat Jan 21, 2023 10:58 am

Hi

I have been contacted by some Solicitirs who are sure they can apply priority service even for a new application. As I don’t want to pay them merely for that while I can apply for my wife without any solicitor need. Anyone have an idea how these solicitor can do that as right now priority services are open only for existing application.

Thanks
