Fiancee Visa

Post by Daz1738 » Tue Mar 03, 2020 11:24 am

Hi guys,

I was wondering could anyone give me some advice around accommodation requirement?

I am a minister/pastor and I live in a manor owned and provided by the church. In my employment letter they have confirmed they own the house and given the address etc. I have also provided council tax bills and utility bills. Will this be enough for proof of suitable accommodation?

Also do you have to send passport photos of both applicant and sponsor with the application?

Better to ask for a separate noc letter allowing your partner to stay there with you. Keep separate to noc letter & employer letters.

No

Required or desired?
There is certainly no reference to a requirement for this in the accompanying documentation or AccessUK form.
Anecdotally I have heard this has been requested following the application.

If you are not sharing with none-related adult then it wont be needed. However, your noc letter can confirm that with new arrangement where your partner will be living with you wont cause any overcrowding.

Financial requirements

Post by Daz1738 » Sat Mar 07, 2020 4:59 pm

Hi guys,

In form VAF4A 3.12 it asks ‘has your sponsor been im employment with the same employer and earning the amount, as detailed in 3.11 above, continuously for 6 months prior to the date in application?”

I have been with the same employer for nearly 4 years. My stipend increases on 1St January each year. For example it was £26,046 from Jan-Dec 2019, as of Jan 2020 it is £26,646 (about £30 per month after tax).

Do I answer yes or no to the question asked?

Do I need to submit more evidence? For example 12 months of payslips and bank statements instead of 6?

If you have been earning above the financial requirement and have been with the same employer for longer than 6 months, then you would meet the criteria to apply under Category A and only 6 months of payslips and bank statements would be required. If you choose to, you could also apply under Category B and supply 12 months worth of payslips and bank statements, though there appears to be no reason for doing so nor would there be any benefit to this in your case.

My argument towards answering "yes" to this question would be that you have been earning an amount above the financial requirement continuously for at least 6 months with the same employer, which would be the requirement for Category A and is what the question seems to be asking about (and should ask about if it were written better). That said, one could also argue that, strictly following the exact wording of the question, the answer should be "no" if your earnings have changed. I would answer "yes" but have not actually applied using this form, so others who have some experience may have a different opinion.

Thank you for the reply.

My next issue would be if I were to apply with 12 months of evidence that my address changed in July 2019 because of work. I was moved from one town to another. Will this affect things in any way? My bank statements and payslips from March-June 2019 would show a different address than July 2019-Feb 2020

Thank you.

One of the immigration advisors I had spoke to said it would have a bearing but I could not understand why it would.

If you aren't using these for cohabitation purposes then no issue but ideally the address should be updated immediately.

my 6 months of evidence for the financial requirements all have the updated address on them. It's only the period March-June 2019 that would have the old address if I was submitting 12 months of evidence.

From what I am seeing here 6 months evidence should be okay to submit. My employer letter states the two different salaries. In a cover letter should I tell them to calculate threshold based on smaller salary? Which still exceeds minimum requirement.

In the VAF4A Appendix 2 document there is a free text section after the financial requirements. Rather than a whole covering letter explaining how you're earning above the minimum requirement, you could just add a note here. Personally I had the same situation and added a note here, no problems.

Guys,

When printing VAF4A do you need to print the whole thing to submit with your application or just the parts you filled in?

All pages should be printed wherever needs.

Fiancée visa

Post by Daz1738 » Fri Mar 13, 2020 7:39 pm

Hi guys,

Sorry I keep posting lately but we are on the cusp of submitting:

1. Do you need an index at the beginning outlining all your supporting documentation?
2. As part of our evidence we have engagement cards, do these need photocopied onto A4 paper?
3. In the automated document checklist you get after submitting online application you there are three boxes at the end and the first one asks “the documents ticked in this checklist are all of the documents i wish to use to support my application”. Do I leave this blank because there is a lot more information to put in than what the document checklist gives?

1. I don't think this is a "need" item but many people do include one to assist in the organisation of their documentation and making clear where things are.
2. Suppose it depends how you are submitting the documentation. Since most things are submitted electronically now, it probably doesn't matter as much compared to when paper copies of everything are submitted.
3.I'm not familiar with this form, but to me it seems more of a prompt to indicate that you have submitted everything you intend to more than anything else. Again, probably the type of thing that will have little impact on how the application is assessed.

Hi everyone,

Does anyone know what to do if you need a visa for a wedding on 11th August this year? Is it looking unlikely?

We had applied and paid the fee. We were less than 24 hours away from the biometric appointment before all centres across Europe. Does the 60 day rule still apply in terms of the application being withdrawn after that or will they hold it until everything is running again?
