Date of application on Spouse Visa

Hi experts,

I am looking for some advice here. The situation is as follows

Wife's current spouse visa expiring on 20-08-2021. I submitted an online application for visa extensions on 04-07-2021 and booked an appointment at the Core service point for 30-07-2021. My understanding is that we can apply for visa extension 28 days before the current visa expiry date. I am seeking guidance on the following

* The date of application on the online form is outside the 28 days eligibility window. Would that be a problem? Which one should be within the 28 days window? the date of appointment or date of application?
* If the date of application on the online form is what they are going to baseline, should I cancel/withdraw the application now and reapply once we are within the eligibility window?

Any help or advice will be highly appreciated.

Thanks for your reply. I am on ILR and my wife is currently on a spouse visa(Family route - spouse visa - partner of someone settled in the UK). Her visa is due for renewal by august 20th 2021(2.5year extension).

Why did your spouse change visa categories??

She works for the NHS and we had to change categories so that she could apply for a doctor in training post(Non EU citizens were not considered during the first round of placements until 2018 and had to wait for available posts after the first allotment). So had to change to a spouse visa at the cost of resetting the ILR eligibility clock.

What date was her first FLR M visa issued?

Date of issue - 23/01/2019
Date of expiry - 20/08/2021

You applied a bit too early but you should be OK as the new visa will be issued from the date of approval.

Great thank you! I hope this won't cause any issues when applying for ILR? For that reason, I was leaning towards withdrawing the application and reapply at a later date.

Sorry for back and forth on this one! I think there will be a short fall of 18 days for ILR eligibility.

First FLR M visa issue date : 23-01-2019
Valid Until: 20-08-2021

FLR M extension application date : 04-07-2021 (2 years, 5 months, 11 days)
Priority appointment booked for : 30-07-2021(need to travel to India mid August)
Expected visa issue date : 30-07-2021
Expected valid until date: 30-01-2024 (2 years, 6 months)

In this case I may have to apply for an extension before we can apply for ILR?

Ilr an be applied for within 28 days before reaching 60 months on FLR M visa.

Hi All,

Just wanted to let you know that the visa application was successful. However on the application outcome email they got the visa validity date wrong. Instead of 27 Feb 2024 the email says 27 Feb 2021. I guess the only thing I can do is wait for BRP and official letter and then notify them about the error?

Received the BRP and as expected it also got the date wrong. Emailed for admin review and also notified the error via online portal. Is there anything else I need to do? Also can she work while they fix this issue?
