Early spouse visa extension.

Early spouse visa extension.

Hello respected member,

We are in a situation where we need to possibly extend my wife spouse visa early to take care of urgent family matters back home and need advise from forum members.

My wife was granted spouse visa on 20/12/2020 and she entered UK on 14/02/2021. Her initial leave is expiring on 21/09/2023. What is the earliest date we can apply for extension so we wont have issues with ILR application?

Is the 30 months period calculated from visa issue date or when she entered UK?

Depends on how long the stay in home country is she may still be able to go and return within her visa validity to apply FLRM. There is no absence limit on spouse visa.

Say you applied on 20/09/2023, and she was granted a 30 month extension, that visa will be valid until 20/03/2026.

Based on her entry she will have been here for 5 years on 14/02/2026. So you'll have around a month to apply for ILR.

I would delay the application till near expiry for FLRM, and then get biometrics within 45 days. The later the better so you'll have a chance of doing ILR easy.

Thank you sir. Hypothetically lets say her visa is granted by end of August 23 if we apply on 17.07.23. What will be expected visa expiry date on new visa? Will it be 30 months plus 28 days from current leave or the maximum she will get is 30 months?

Its good to know that there is no absence limit. Its just our situation is so fluid with a health situation back home that we need to travel back and forth. He nce we are planning to go about this with best solution possible.

Your calculations is correct, you still got to scale the extension hurdle 1st.
