We just sent a normal photocopy of the passport, and the application was accepted that way. You will be asked to send "recent evidence" anyway once your application has sat in the queue for 5 months, and that is when they ask for the passport to be sent in. It worked for us, and overall it seems like a rather reasonable improvement of the process.

In a perfect world, you would not have to play these tricks. But as long as the applications are queued for so long that the evidence is then considered out of date, you should look after your own interests in the mean time. I do still wonder why they make this process so complicated for all sides involved, but I guess that is not really my problem.

Hi Guys,

I have filled EEA2 and arranged all of my documents to be sent. I just want to double check two things before I send. My wife has European passport with Greek Cypriot nationality. She has been in UK since 2001. She studied in UK until 2005. Then she went back to Cyprus in mid of 2006.
In May 2007 she came back and in October 2007 we did our court marriage. Since then she has been working on and off on contract basis.
To best of my understanding to be able to apply residence card for EU national’s spouse, EU national should be practicing EU treaty which means this person should fall in one of following category,
Student: which she not any more.
Employed: on and off
Self employed or self sufficient: I support her financially.
I am in full time permanent employment for almost one yeah and have been employed on contract before that as well. So what did I have filled the employment section with my detail and got it stamped by my employer.
Because my wife was without employment for good 3-4 months and had been looking for some work, until she found another contract based work last week.
So here is the list of my document that I am going to send to support my application
• My passport
• My wife’s Passport
• Form EEA2 filled with my employment detail
• My last three months salary slip
• My last three months bank statement
• A self addressed special delivery envelop.
Question is,

Shall I send any document about my wife’s work such as salary slip which she would have only for one week and bank statement that would only have very limited fund as I support her financially,
All suggestions are highly appreciated. It’s really unfortunate that they made the process too slow and complicated.

Hi Tom,
a quick question, if photocopies of the passports (eea & non-eea) were sent and when the HO going were going to make the decision, will they give us the residence card in a piece of paper(?) ? As I read many got theirs on a paper instead of in their passport.

Reason am asking is because we are compiling docs and stuff now and my bday is coming up in 3 weeks and we would like to visit my family in law ( during the bank holiday week); dont want to give our passports away and at the same time dont want to delay the application any longer; and dont want HO have any reason to reject our application coz we didnt provide any original passports.

so .. really really ok just to send in the photocopies? just worried..

Someone stated that the HO would ask for the passports, if they did not have notarised copies. I think this does make a certain amount of sense: if you just send a simple copy, that is probably not sufficient evidence, and they will ask for the originals. But I am not sure how they would handle boundary cases, for example if the HO has seen the passport previously etc.
and dont want HO have any reason to reject our application coz we didnt provide any original passports.
According to the procedure, they have to ask for missing evidence, and this does include the passports.

This is slightly off topic, but what difference does it make to the non-EEA spouse of an EEA national whether the EEA national has a registration card or a permanent residence card? Is there any advantage if the EEA national has a permanent residence card? From what I understood, the non-EEA national needs to have himself lived in the UK for 5years with the EEA national spouse before he can apply for a permanent residence card regardless of whether the EEA national has permanent residence card. Is that right?

It's your wife who need needs to show that she has been exercising her treaty rights so she will need to show that she's working which means you need to send her payslips or bank statements.

But When I filled my EEA2 Form my wife was not employed
and now she has been working only for two weeks
will it make a differece on decision if my wife has a contract role not permanet.

Also she has got only two pay slips (Weekly) will that be enough?
