Hi. Plz can anyone tell me if English test requires for spouse visa within uk? One of my friend applying for spouse visa. Thanks 🙏

Yes, minimum IELTS A1 if this is their first spouse visa application.

What visa does your friend currently have?

He is illegal in this country for 21 years. Applied for pre euss but got refused due to not having any residenc card . So now somebody suggested spouse visa is the option.

They married in September 2021. Wife eu nationality with one son from previous marriage. She have part time job earning around £700 month and have £63000 something in saving account. They live together since 2019 . She have her own house.

Difficult to switch to spouse leave in-country.
Also consider Private life?

If she has enough savings in her account, why can’t he return back to his home country and apply for fresh entry clearance as a partner under appendix FM?

Bear in mind, if they found any aggravating circumstances in his future application then he is likely going to be refused.

How did they get married if he has no status in the UK?

Did they get married after giving notice at the registry office and getting ukvi approval?

Yes . They gave notice to marry in registry office . Short interview by staff in registry office. Registry office said they have to wait for home office inquiries if they want to do any . Waited around 2 months but home office didn’t take any action. And finally they got married.

Residence requirements for an adult on the Private Life route (including a young adult who does not qualify under PL 4.1.)
PL 5.1. Where the applicant is aged 18 or over on the date of application:

Does he need letters for all these years? He have stamp in the passport when he arrived on Gatwick airport. Now from 2019 he got all the correspondence where he is living with his wife like water bill , energy bill etc . On on both names .
