Fiance Visa or Spouse?

Post by Clanricarde » Mon Apr 08, 2024 9:24 pm

Hi there - would be great to get some advise on this dilemma:

My partner is a US citizen and I am a British citizen, we are planning to get married soon and for her to move to the UK. We both meet all the criteria for Fiance and Spousal visa. However, in terms of the cost, length of the process for her to obtain UK citizenship and speed we were wondering which one of the following is the most efficient route:

1. Apply for her Fiance visa, get married in the UK and then apply for spousal visa afterwards? (Straightforward route I suppose)

2. Apply for the spousal visa from the start after she visited the UK on a tourist visa? (Given we get married while she is here visiting, don't know if that would be allowed)

3. Get married in the US and then apply for UK spousal visa for her to come here? (Would the UK Home Office accepts that?)

I am wondering if we apply for the Fiance visa which costs nearly 2 grands, we then have to pay again for the spousal visa (almost the sams amount for 30 months), so why not apply for the latter from the start?

2. Apply for the spousal visa from the start after she visited the UK on a tourist visa? (Given we get married while she is here visiting, don't know if that would be allowed) Strictly not permitted.

3. Get married in the US and then apply for UK spousal visa for her to come here? (Would the UK Home Office accepts that?)
Best option if you meet all the criteria.

Thanks a lot for the prompt response.

Would you be able to give an estimate of the time it takes for option 1 and 3? Also the cost if you could please. Really appreciate it.

We would be able to do option 3 in the US as it is easier to obtain marriage licence in the US, we are just wondering which would take less time. Given that cost is a secondary priority.

Thanks a lot.
