Financial requirement for Spouse Visa

Post by zakali92 » Mon Sep 02, 2019 3:16 pm

Hi All,

I am quite new here, apologies if this has been asked before (I've searched, couldn't find the answer).

So I am in the process of applying visa for my wife (who's in Pakistan) and I am British resident born in the UK.

My last employer I worked for:
May 2017 - February 2019
Annual Salary: £26.5k

My current employer that I am working for:
Since June 2019 - Present
Annual Salary: £30k

I have been working for my current company since June 10th 2019, so for more than 3 months.
I unfortunately got made redundant at my last job which finished on 28th February 2019. So I was out of work for March, April and May.

I understand I need to provide 12 months worth of wage slips and bank statements for the financial requirement but I have the following questions:

1. Do I need to provide contract of employments for both employers?
2. Does the Bank statements have to indicate from 1st of the month to 30/31st of the month e.g. 1st July to 31st July? Because my bank statements are like 12th Aug to 12th Sept - does it really matter??
3. Do I need to provide redundancy letter?
4. Do I still need my bank statements to be stamped, even though I've ordered these from my Bank?
5. As long as I meet the 18,600 threshold for that 12 month period (Sept 2018 - Aug 2019), will that be fine?
6. Would this fall under category A or category B?
7. Finally, do I apply on visa4uk website or on the official new .gov site (under Appendix FM)??

I have confirmation letter from both of my employers and wage slips have been stamped.

Thanks for your help in advance.

1. No but may need the employer letter from previous employer too
2. Doesnt matter as long as the wages credit entries are appearing
3. no
4. no
5. Yes but caseworker mostly are strict in seeing the last 12 months of payslips
6. category B otherwise you wait 3 months more

Thank you for your help.

I have got the letter from my previous employer confirming my employment in February.

Also, I have 9 months wage slips in that said 12 month period and the gross amount totals up to around 19k, should that be fine?or do I still need 12months of wage slips?

Sept 2018 - (old employer)
Oct 2018 - (old employer)
Nov 2018- (old employer)
Dec 2018 -(old employer)
Jan 2019 - (old employer)
Feb 2019 -(old employer)
March 2019 - No payslip
April 2019 - No payslip
May 2019 - No payslip
June 2019 - (new employer)
July 2019 - (new employer)
Aug 2019 - (new employer)

Preferably apply when you finish 6 months with present employer with 6 months of payslips.

yes
(a) Payslips covering:
(i) a period of 6 months prior to the date of application if the person has been employed
by their current employer for at least 6 months (and where paragraph 13(b) of this
Appendix does not apply); or
(ii)any period of salaried employment in the period of 12 months prior to the date of
application if the person has been employed by their current employer for less than 6
months

Yes, I totally understand that.

What I am saying, is that if I meet the Category B (12 months requirement) then you still think I should hold off for another 3 months?
(ii)any period of salaried employment in the period of 12 months prior to the date of
application if the person has been employed by their current employer for less than 6
months (or at least 6 months but the person does not rely on paragraph 13(a) of this
Appendix), or in the financial year(s) relied upon by a self-employed person.
(b) A letter from the employer(s) who issued the payslips at paragraph 2(a) confirming:
(i) the person's employment and gross annual salary;
(ii) the length of their employment;
(iii) the period over which they have been or were paid the level of salary relied upon in
the application; and
(iv) the type of employment (permanent, fixed-term contract or agency).
(c) Personal bank statements corresponding to the same period(s) as the payslips at
paragraph 2(a), showing that the salary has been paid into an account in the name of
the person or in the name of the person and their partner jointly.

> I have 9 payslips in a 12 month period that equal to £20k+
> 12 month bank statements from the bank showing the 9 payslip amounts entering bank account
> My gross salary is £30k at the date of application (hopefully this month)
> I have letter from both my former and present employers confirming employment with salary, job title, confirming payslips, permanent job etc.

Are you saying because they are strict with 12month periods?? but if I am meeting requirements surely there's no issues.

Thanks for your help in advance sir.

Thanks for that.

I've read through that case, and it was unfortunate for him and it wasn't his fault at all. It was UKVI and VFS mistake for not uploading all the documents.

That brings me to my next question, talking to a friend, he's told me as part of the new gov site, all teh documents are uploaded by ourselves not via VFS physically is that correct? because if that is correct, surely that shouldn't cause problems as long as I ensure everything is uploaded?

Thanks again for this.

Hi Zaka

I uploaded all the documents myself for my spouse on the VFS website. It constantly crashed and deleted documents after uploading. However, i managed to upload everything before the biometrics date but not sure what the caseworkers will see when they check on their side. It's all a bit risky. We are still awaiting a decision on our application, so I can't tell whether the documents have been approved.

Thank you Fifi,

My friend said the exact same thing as you about the VFS site being awful. Can you see from your side what you've uploaded?

Am I right in saying you did the online application on the gov site and then it re-directed you to the VFS site to upload all the supporting documents?

Yes - we applied on the gov website and then were re-directed to the VFS website to book the biometric appointment and upload the documentation. I haven't logged in recently to see what i've uploaded, but it was there the last time i checked.
It may be working better now - however if not, then you (i'm assuming you're the sponsor based in the UK) can have documents uploaded for a cost of £75 at one of the UK centres not VFS so no chance of them being incorrectly uploaded or missed.

Also, i would recommend that you wait until completing 6 month's employment with new employer - just for ease and no room for error (hopefully). Personal recommendation only.
Have you been married long? If not, it will build more time to show subsisting relationship too.

So these UK centres are different to VFS centres? where can I view them?

Also, did you have 6 months payslips?

Looking at the above, I meet the financial requirement, what do you think, surely it should not go wrong as long as I provide everything and it gets uploaded?

Off topic - shouldn't we complain about this?

The /VFS and the VFS website being awful, I've had a few people say there are technical issues with it especially when uploading supporting documents with consistent crashes etc. For something as sensitive as spousal visa, it is having a detrimental impact on people's applications, especially considering someone's application got rejected when they provided all the required information as per legislation. Seems a tad unfair.

Where are you based? London?

I provided 12 months payslips - but that's because i took a one month sabbatical to get married and received no pay for that month. If you feel you meet the requirements then by all means, go ahead. I don't know the other categories to meet the financial requirements so can't really advise on that aspect.

You should read the reviews for VFS website - they are awful and they barely score a 1 star for their service. However, it won't change anything!

I am based in Worcester, near Birmingham. I added all the gross amounts for my payslips (6 from old employer, 3 from new employer) and they totalled to £20k+. So I was thinking category B. I have payslips, letter all signed and stamped and 12 months of bank statements from Bank. Salary is paid monthly. Monthly salary is £2500 before tax, right now. For my old employer it was £2208 before tax. Very concerned about this VFS website, whether I do it now or later.

I am waiting on my housing report and will pay for Title Deeds, that is all that is remaining. My wife has completed her English test in July and TB test in august.

I was going to go with solicitor who is good but charging £750 for an online application and advice. He advised with my current financial circumstances I could apply.

Locations to submit documents in Person under Option 3:
London: 66 Wilson Street, London, EC2A 2BT
Birmingham: 5 - 14 South Road, Smethwick, Birmingham, B67 7BN
Leicester: C/O Peepul's Centre, Orchardson Avenue, Leicester, LE4 6DP
Manchester: 50 Devonshire Street North, Manchester, M12 6JH
Liverpool: SUITE NO 207, Second Floor, Graeme House, Derby Square, Liverpool, L2 7ZH
Bradford: Skipton Chamber 16-18 North Parade, Bradford, BD13HT

They are the locations where you can submit documents - i believe it's a walk in so no need to book an appointment. You will need to take the application form or GWF number with you and the checklist i think - you'll also need your wife's TB test cert and IELTS/English language docs (in case you don't already have this) The good thing is, they now also accept copies so no need for originals.

Have you gathered proof of relationship etc too? Pictures of wedding etc and evidence of communication (WhatsApp chats etc)

Tbh - if your case is straight forward, then apply yourself if you're comfortable to - the level of knowledge here is amazing! The moderators are really good too and you'll get all the answers you need.

Hi All,

In regards to Bank statements:

When they say they should be no older than 28 days, are they referring to the latest one?

Also, does each statement have to cover 28 days?
Only reason for me asking is that my bank statements arrived today, some statements cover 30 days, some 31, some 32 and one of them covers only 27 days

Thanks
