Ok of course I can tell you what ever I done and help my solicitor she done very good job

What is your nationality and your partner also do you have kids ?What is your status now and is your work and how much your partner earning?

Also it’s all depend on your witness statment
Explain everything very briefly and in easy words.
Now it’s depend on what grounds they refused
If it’s insurmountable obstacles you have to explain that.and be honest never lie to the court never ever.

I’m Sri Lankan. My partner settled ILR. I’m over stay from 2013. I loss My baby in 2017 . Still birth. His income more than 18600. I gave to home office all my true documents.
Now I add my IAPT therapy service records and medical records of treatment

What’s your husband country of origin ?
Firstly
Write witness statment and explain your insurmountable obstacles you will have its mean you and your partner difficulties if you move to Srilanka how your life and relahsuonslhip will effect.get some country information from home office website.but most probably your appeal will allowed if your witness statment is good and easy to understandable.
Documents you will need
Last 6 months letters to you and your husband
Your husband payslips employ letter,with bank statments to show the salary come in. Also gp letters is important.
If your barrister is good so he will tell you ok same day what to say and be honest to the judge don’t give too much information to the home office just answer what ever they ask you.
Also book conference with your barrister before hearing some of them might charge but don’t know about your one. Before submitting your bundle check it on your barrister if he want to change any thing before you submitting but do it as soon as possible

Everything will be ok.well judges is good they know everything better than the home office case workers. Just make sure your barrister is good and do conference with your barrister before hearing it will be more helpful and he will have good preparing for the case

my application (extension) was straightforward, same day appointment service (submissions, interview & biometrics) in Croydon.... That was in May! Still no decision. What do I do?

Finally received my passport on Tuesday morning. I had to write a letter to the sheffield address on my decision letter requesting for my passport back, also called the Croydon office as thats where I submitted my documents. Eventually they sent it. I've now booked an appointment with the French Consulate for my Schengen Visa. I Cant wait.

You could write a letter to the address at the top of your decision letter. Let me know when they send it. This people nothing is ever straight forward with them I just tire.

I was thinking of applying for a schengen this week so I can take my family away for a weekend, But with the delay of receiving passports back I don't know when that will be.

Ah that’s brilliant news.

I’ll write them tonight, by send first class post tomorrow, I wish they had an email I could even write to. They haven’t even sent me the decision letter to start with, they only sent all support documents back with the BRP

Haha! Brilliant I bet you’re mad excited about your holiday.

I was so hyper but now they’ve killed the spirit 😂. I just pray they haven’t lost the passport because Nigerian high commission is a mad house.

I’ll let you know when it comes

Thats one thing I was so scared about. Cos it took me a lot to even get the passport at the Nigeria high commission.

Nah let's be hopeful, Fingers crossed they send back your decision letter along side your passport soon.

Yea i'm sooo excited to take my son to France, to be honest I just want ti get on the plane hahah :D

Applications depend by who is handling your case.Some are lucky it comes out quick some delay.
I bet it's ready just sitting on someone's table until they decide to release the decision.So dont worry yourself...

Auk333 - damn fantastic news that appeal has been allowed. How the HO get away with this behaviour is beyond me. Let us know how your hearing goes okay.

Husband's timeline - overstayer 11 yrs
08/16 - FLR (FP) Partner, refused 02/18, 03/18 - JR permission refused with merit
08/18 - FLR FP (Partner) PSC - Approved
07/20 - FLR FP to FLR M Switch - Approved, 03/23 FLR M Ext Approved.

Your story really gave me hope Seriously.
After lots of refusel I got right of appeal. My all experience is when my student.that time I have applied for flr fp which was very weak case but the solicitor I have used for appeal he lodged appeal very well but my mistake I changed it for no reason to a thick solicitor which he is barrister too and that was my big big mistake I done . He charged me a lot and didn’t work a tiny bit for appeal bundle and even didn’t talk in court any way all appeal rights finished and changed solicitor and went for new one start from the scratch submit new application in time April 2017 and married in August 2017 which we Plane to get married after our engagement in 2014 and chose the date August 2017 lol.
Application refused in 15 December 2017 but I was reporting and they served me with the decision in person 6th of March 2018 same day detain and same day released on bail. We had 7 days and submit new application in time and the refused it in 3/4 days and decision served again in person when I was reporting.
And detain me also been told we sending you back now your flight is tonight I have claimed asylum so my flight was cancel and we went to court for judicial review. Released after 8 days and been told attend asylum interview which I did and later sent a letter to withdraw asylum and wanna wait for my pending judicial review which my judicial review refused in October 2018 and in 7 days submit this application which is refused on 11th of June 2019 appeal lodged in 14 days and hearing date I got in 7/8 of July hearing listed 10th September which is allowed

Long story but my experience is if you go for inexperience Solcitor you will suffer a lot and the money you they taking from you it’s like twice than a good barrister who can do it better than them on direct access.the poor representation waste my 4/5 year and money a lot.
Still not sure the home office will Appeal it or not but at least some positive outcome I got now.

Our case look similar. Refused with no right of appeal. Applied for Judicial Review, home request for permission to withdraw my application for judicial review and change decision to in country appeal.

Do you know how I can claim my legal cost back or what do you advise.

I think you can’t claim back any cost till the judge decision.but it’s very good they re-considering the application also don’t go for judicial review straight away because it’s a bit dangerous process if they refused you. In cases like that if you netting the 18600 requirements best thing is to apply from home country. I was mentally ready for it if my appeal dismissed next day was gonna go back and re apply from there. I be miss guided from previous lawyer and keep telling me no apply here because each application he was charging me

Home office has withdraw the judicial review.

They now made another decision after the withdraw, they still maintain their initial decision, this time gave me in country appeal, my question is, can I claim for my judicial review legal cost since home withdrew or wait till the outcome of the in country appeal.

I am not sure about it. But I think when court decide and they order for cost to loading party.if you done it through solicitor I think he might know about it

Finally, I got it today! imagine the letter was dated 20th August, So it was just sitting down somewhere!

But i am glad it's all over. I'm trying to book for my schengen visa now! lol

I also can not wait to take my son on holiday and also to get on a plane, I love flying.

Super Excited now.

Application submitted:05/04/2019(0nline application), Biometric done 11/04/2019. received a letter last thursday 12/09/2019 the letter dated 11/09/2019 for further documents my ex partner original british passport to verify the letter she wrote when i submitted my application and letter from my son's GP for evidence of contact to my child. does anybody in this situation?

Application submitted:05/04/2019(0nline application), Biometric done 11/04/2019. received a letter last thursday 12/09/2019 the letter dated 11/09/2019 for further documents my ex partner original british passport to verify the letter she wrote when i submitted my application and letter from my son's GP for evidence of contact to my child. does anybody in this situation?
