Hello guys, I need help.
i apllied for flr fp based on british wife and son on 20 june, i was on tier 4 with valid leave. but we meet financial requirement now as its been 6 months since my wife started work. So can i vary my application to FLR (M), because i am concerned that lots of flr fp application are being refused even though having british wife and british child.

Hi thanks for your reply. As you can imagine, we are all a little low today, but now have the letter to hand. The reasons for the refusal, is that I was sentenced for fraud in 2005, for 15 months, and that is not spent yet...?? Furthermore, I have 4 drink driving offences in 20 years and have deemed me a persistant offender.
Also states the usual blah blah that my wife can assume the role of sole parenthood etc, and that I must still have ties to Zimbabwe.
Please people any suggestions would be sooooo appreciated. My lawyer reckons my wife could go to another EU country, and do it that way, or, waiting for a removal order which ""MIGHT"" generate an appeal.
In the meantime, am thinking of writing a reconsideration request letter, but just to buy time really, as they have told me to call my local enforcement team!!!!
ANYONE, PLEAAAAASE HELP, or suggestions....

I'm feeling a little down at the moment. We aren't hearing back from our lawyer she doesn't call back and I feel in limbo. I'm waiting for this to be overturned and not go to court, but the court date is just over a month away and I don't see that happening. Can anyone give me any insight into the court day and how it's going to be? Do we take witnesses?

So sorry for your refusal africanthunder, you have 2 kids 10 and 14 and they still expect you to leave them and go back.
I applied on the same category and it's been eight weeks since application and 7 weeks still biometrics and still waiting. I'm feeling really down

Very sorry about your refusal Africanthunder, your success is just by the corner.
I also applied for the FLR (FP) and this is my second application too, the only difference from Africanthunder is that i and my wife dont have kids yet, only applying based of partner. Its now 11 weeks since application was sent and 10 weeks since Biometric done. Awaiting for documents, approval letter and BRP to be sent pretty soon BY THE GRACE OF GOD. AMEN. I wish everyone else who are waiting a positive news SOON. AMEN.

I am so sorry once again Africanthunder. Since you were convicted your conviction is not spent until after 7 years and since yours is over 6 months, also with your drink driving offenses that's more time on the clock again. This i believe is why they deemed you as are repeat offender. All hope is not lost as we have seen worse cases in this scenario being overturned and since you have kids, whom I presume are British, this is a plus on your side. Though it's not straight forward as it sounds with your history but by engaging in a service of professional barristers, this should fall in your favor. A long road it is my friend but victory awaits you on the otherside. So please do engage wisely and with careful caution with these solicitors cos once you mention these to them, the only thing ringing in their head is Xmas and pound sterling whilst they toss you around like a yoyo. So please do thread carefully. If you need to understand the rehabilitation act, here is a link to help you understand it better.

Hi, I read the last few messages in the tread and wanted to share a thought.
It may seem very hard but if you can just try it you will be amazed.

Choose to ignore the circumstance right now, after all no news is good news.
Think about how excited you will be when you finally get the good news you are waiting for and in that thought begin to rejoice, and if you are of faith, then bless the one in who's joy is your strength.

Conversely If you have had bad new, know that even the lawful captive shall be set free, and if you are of faith then know that these trying are to build you up and there is an end to it, and your expectations will not be cut off. You will yet laugh.

I have applied for flr fp based on my brirish wife and a year old british son, i had valid tier 4 visa when i submit my application, in the uk since 2009. How likely is it going to be successful ? any experience guys, Please give me assurance. Thanks

Really sad for you @africanthunder my heart goes out for you, being in the same boat as you. Arrived in uk as a student in 2003 then overstayed since 2007. married to british wife in 2009 and applied as spouse in 2011 with no kids refused in 2012 then going through all process like reconsideration pre protocol and stuff finally in 2013 got date for tribunal and by the date of tribunal my missus was pregnant with 28 weeks pregnant with twins. Judge dismissed my appeal admitting marriage is genuine but my missus can travel with me back to my country and settle there with kids as she can travel up untill 36 weeks of pregnancy even tho her doctors letter clearly mentioned about her high risk pregnancy and advise of not travelling. Dismiased by upper tribunal in written. After birth of my twins in may applied on flr(fp) 7 weeks ago and after biometric waiting for decision. Hope it work out for all of us here trying to have a lawful and respectful life with our families.

My friend got 30 month visa. Court ordered him residence for his child as his wife is unfit and they are separated. It's so hard for him to work full time and be a full time parent to a child. The child is only 1 year and 6 month and my friend don't get no help e.g. maintenance or child care or any benefits at all. Is there any help he can get from the government as he is desperate and helpless. He can't leave the country as ex has written to his solicitor s he can't take their child outside the country. He wants a divorce but she is saying to pay her £6000. Please advise alk your advice will be appreciated. Thanks in advance

My soli contacted tribunal and tribunal said they have back log and they are currently dealing with appeal dated 9th July and my soli submitted it by special delivery one day before lasts day of appeal

As a result my appeal is not yet processed

That's why home office saying no right to work


Can this be the case ??????

Hi fellow blogger, in response to this, I have been undecided as to tell my employer about my situation, they do know about the visa (as I submitted it when I was initially employed) however the person that employed me has left.

Therefore technically I haven't done anything wrong by not telling them, my visa ran out in May and they haven't said anything. I have my appraisal on Thursday therefore do you all think I should tell them And risk them letting me go ? Or should I keep quiet and hope HO don't contact the employer ?

Essentially what I'm asking in all your cases above , Have HO CONTACTED YOUR EMPLOYERS ?

Welcome on board Manirem. Your situation is a down the middle 50/50 split. As easier as it sounds to say not to tell them, it's also cruel to say you should especially when you have to survive. Appraisals could raise the questions but not necessary since your visa expired in May. It is the company's responsibility to raise the issue with the home office because if the Home Office themselves do go there they will be facing a fine of up to 10 grand if you are found working there. But then again, if they have not contacted you, your work place I mean, since may, I doubt they will raise it with you during appraisals because they should have notified you at least a month or two before your visa expired. If you feel confident to keep working there, then please do so. I do hope this helps your question.

I havent done much since getting my stay, still as skint as i was lol. Only good thing is am gonna take my driving lessons now as been relying on a bus that comes once a week!

It was form flr o am a mum with 3 British kids aged 7,3 and 6 months and my partner is settled here on ILR so was initially given 3 yrs and so this is an extension

You are all wonderful and i thought i should share my story to encourage those in similar situation and how wonderful my God is working with those who trust and believe in him.
-well came to uk 2004
-caught with bad visa 2005 while looking work ,seek asylum straight
-tell to report at eaton house every forth night,sign on for 6mths and stop because i don't want to be deported with my baby.
-2008 married to eu national who is from my country ,sent in application same year as a wife,i was granted 5 years,then 2010 my then hubby call H O that is no longer interest( because i did not worship him because he gave me paper :cry: ) 4 imm officers came to my house took my passport and called my employer that i dont have bases in uk again.
-2011 i decided to applied to ukba base on my child who was 5 year but was refused in 2012
-2013 april i applied base on 7 years child born in uk refused in may 2013
-started JR 2013 july ,tsol seek 3 extension my lawyer said no more extension
-nov 2013 tsol asked me to withdraw for them to reconsider with no cost we accepted
-may 2014 a letter to tsol that 3mths lapse already ,they reply with apology letter that 30 july unfailing that i will get their letter
29 july lawyer called that he hasn't got any letter yet,they told him that i have been granted limited leave.
4 august all document received with my BRP 2.5 year with public fund.
HAVE FAITH,BE PRAYFUL,TRUST GOD IS MORE THAN ABLE
GOD WILL SET YOU ALL FREE FROM IMM BONDAGE SOON

Greetings my forum family. Hope I find you all in good health. Congrats to those who have been granted and to the those who are still fighting, my message remains the same. Trust in God and keep fighting.
Just thought I'd update you on my case. My last post was about the amoebae writing to me and saying I should withdraw with no costs but I decided to stand my ground and wanted my costs. My family has suffered unnecessarily and with that in mind I wanted my costs covered.
Well, I hadn't received any response from the half a brain cell amoebas since I made my demand 3 weeks ago. So today I decided to ring and find out their position as it's getting closer together court date. I contacted the person who sent me the letter and who didn't even bother to acknowledge receipt of my emails and was told that I'm no longer dealing with your case. Was then put through to the one who is dealing with my case now.
Lo and behold, I was told that a letter has been sent out to me on Monday. I hope to receive it tomorrow. I asked what their position was and I was told that they have agreed to my demands. The good Lord is showing his powers to those that find pleasure in seeing people suffer. When the chips have been down, I have remained faithful and I know the good Lord will safely guide me through all this.

Nilemarques I hope I don't look or sound stupid by saying this is good news. If they have agreed to reimburse the cost it sure sounds like GodsAuthority. They reimbursed it and was then granted. Sounds like victory to me and I am positive of this. My prayers are with you and I know victory is ours eventually by God's grace.

Just thought I'd update you on my case. My last post was about the amoebae writing to me and saying I should withdraw with no costs but I decided to stand my ground and wanted my costs. My family has suffered unnecessarily and with that in mind I wanted my costs covered.
Well, I hadn't received any response from the half a brain cell amoebas since I made my demand 3 weeks ago. So today I decided to ring and find out their position as it's getting closer together court date. I contacted the person who sent me the letter and who didn't even bother to acknowledge receipt of my emails and was told that I'm no longer dealing with your case. Was then put through to the one who is dealing with my case now.
Lo and behold, I was told that a letter has been sent out to me on Monday. I hope to receive it tomorrow. I asked what their position was and I was told that they have agreed to my demands. The good Lord is showing his powers to those that find pleasure in seeing people suffer. When the chips have been down, I have remained faithful and I know the good Lord will safely guide me through all this.

Nilemarques I hope I don't look or sound stupid by saying this is good news. If they have agreed to reimburse the cost it sure sounds like GodsAuthority. They reimbursed it and was then granted. Sounds like victory to me and I am positive of this. My prayers are with you and I know victory is ours eventually by God's grace.[/quote]

Hi All, Just wondering if there are anyone here still waiting for a response from the HO after taking Biometric. Its now 12 weeks after i had biometric taken and 13 weeks after application was sent and no response yet. Anyone else still waiting like this, this is really frustrating.

Hi icehouse256, it's been 8weeks since biometrics and I just called the home office and they told me a package has been sent to me on the 4th of August but haven't received anything yet. The tracking number doesn't give me any information . Omg I'm so nervous, has anyone experienced the same?? Is it a refusal??
