You have to ask, our solicitor sent the officer a couple of letters because we believe their reason for refusal was incorrect and we were hoping it could be overturned. It wasn't.

I just want to say thank you to all those who have shared tips and experiences of court experiences. I wish everyone on here waiting decisions the very best!

I do have one more question though as far as witnesses go. Are they important? I have lots of people we could ask but they're family so would obviously say the 'right' thing, would it help or is it a waste of time? We had a lot of statements sent
with our supporting documents backing up my husbands good character, from family, friends and even the managing director of the care home my aunt is in saying how he faithfully visits with our daughter is upstanding etc. I feel it's clear to see he is a good person, the witnesses would they make a difference?

I'm so nervous, sometimes it feels like this process and court date has been set so soon, it's as if they're ready to just say no

please be optimistic irrespective of your situation. They will not say no.
About witnesses, you may want to check with your solicitor if you have one, otherwise the decision is entirely up to you, but do understand that if your witness is over 18 years you may be cross examined separately. (My Opinion - I think the strong written statements are good enough) Good luck.

Hi Silverbird. Greetings all the forum family. @Silverbird, i'm not sure if i getvyour question correctly but i'll just give you my circumstances hoping they will answer your question.

I applied FLR O in May 2012. Was refused. Reasons for refusal were the norm as for everyone else really. E.G you lived most of your life in country so you can go back, your children can leave with you etc. I did a PAP, which was refused on paper with the judge citing the same refusal reasons as the HO. I then applied for an oral hearing which was granted and was supposed to be heard in court tomorrow.

A few weeks ago, the HO requested i withdraw and they will reconsider my case. I agreed subject to my terms. The Consent order has been signed by the judge and i'm now counting down the 3 months for a new decision. If the new decision is a refusal again, it will come armed with a removal order which will afford me a right of appeal and the process goes on.

@Winners. So sorry to hear of the refusal. The HO are just playing games with peoples lives!! If i may ask, was this an official reconsideration which the HO said they would do or was it just a letter you wrote to them asking them to reconsider?
If it was the official one, did they give you appeal rights? If not, maybe think of going down the JR route. They also did that to Shondra.

Winners! Please note all hope is not lost. I agree with Kukuwife and nilemarques that you should proceed to JR. Do not give up please. The amoebas are only delaying the inevitable. {{Hugs}}

PAP-REFUSAL started btw Nov2013-Aug 2014

The reconsideration refusal was after i agreed to withdraw my JR application around July 2014

Still the same reasons of not having sole responsibility over our children

In Country Appeal was given

My solicitor said i should be expecting Feb or March next year for Court hearing which make me more sad

Is it possible for H O to withdraw before Court hearing and grant L R? Please

There is actually nothing to prepare for, the HO presenting officer was only asking questions and all the questions were just affirmation of my written supporting statement. Take your time to write your statement and do not lie in your statement, because you will not have the statement in front of you.

However, your solicitor would be allowed to cross examine the HO presenting officer to further stretch your point. And if you have a witness, they will be called in after you've given your evidence and afterwards will be allowed to sit behind you at the public place.

It is a very relaxing atmosphere just be yourself, and relax. I am still awaiting the outcome of my appeal by the way, I'm seriously praying and keeping my fingers crossed that its in my favour.


I wish you a successful outcome, and remember prepare your statement well, you will not be given opportunity to talk much rather than to answer the questions that is being asked.

how old was your son when u had an hearing and how long u lived in uk when u applied case?

I am neither (not british child, oldest child 6.5)
I applied student visa, then varied to flro while i was pregnant.
home office claimed I have over stayed, because my flro was returned as invalid, case worker refused to see its a variation and not a new application because i paid the difference of the fee and not the full flro fee.
Hence my appeal is in two fold
1) unlawful decision - I am not an overstayer
2) we are praying for discretion

Appeal date is end of october, still putting support docs together and praying forGod's intervention.
