FLRM EXTENSION

Hello Folks!

I'm in the middle of applying for FLR(M) for my partner, I just needed help with the financial requirements evidence.

I have been working with the same employer since 2015 until now I was a non-salaried employee back then getting weekly pay of £630 gross pay before tax, but recently I have changed my job role from 11 November 2019 with the same employer and now I am an salaried employee which I receive payslips every month (already have received three monthly payslips for November 2019, December 2019 & January 2019).

My question is that when it comes to satisfying the financial requirement would I need to show 3 months payslip from non-salaried (the weekly payslips) and 3 months of salaried payslipS? As I have been getting monthly payslip from November 2019, December 2019 and January 2020 and previously I was getting paid weekly, so that in total would be 6 months payslip.

Would this be a Category A or Category B? And from what I do know is that these two can not be combined..?

My partners VISA ends 14 April 2020 and would want to start the application as soon as possible as she has gone the 2.5 years mark now for her to extend.

Could someone please assist me with would be really delighted.

you can apply under category A. However to keep the calculations easier if your 6th monthly payslip arrive before your visa expiry then use your 6 monthly payslips only (Nov-Apr) with salaried job.

By the time my 6th payslip arrive the visa would of been expired & I want to apply end of this month.

Can I use 6m payslips, so that will be 3m x weekly (non-salaried) and 3m x monthly (salaried)?

Yes provided the lowest wage figure during the last 6 months never below than £1550 per month. Also get it clarified in employer letter that from Nov you are getting monthly wages.

One of the other things that I’m not too sure of is when is the earliest date I can submit the FLRM online application and attend the UKVCAS appointment?

Just to clarify:
My partner entered the UK: 20/07/2017.
BRP Valid from 17/04/2020.

Could you please advise me on the earliest time to apply and submit the FLRM online application form and attend the UKVCAS. As I am currently trying to do this as soon as possible even before end of this month if possible. Or will I have to wait until 20 FEBRUARY 2020 (28 days before visa expiration (17/04/2020).

You can apply 28 days before completing 30 months from the date of entering the UK. But unless the visa rules including fee change usually from April or personal circumstances not changing then preferably the extension should be applied very close to visa expiry to avoid any shortfall.

So does that mean I can apply on 19/01/2020 or 20/01/2020 (being the last day) because I’ll still be in within the 30 months of entering the UK calculating:
Entry to UK: 20/07/2017
On the date of 19/01/2020 will be 29 months and 30 days.

And on the date of 20/01/2020 will be exact 30 months.

After this is submitted I can attend the UKVCAS at any time can’t I as I will of already submitted the FLRM online application form in time within the 30 months of entry into the U.K.

Please advise me on that.

From 23rd Dec 2019 till your visa visa expiry you can apply anytime even now.

To complete the application you will have to enrol your biometrics through ukvcas usually within 40 days.

I can apply from now on for the extension and submit the application and book the biometric with the UKVCAS within let’s say by 31/01/2020. (In other words can I complete everything including the application form and book biometric appointment by the end of this month)?

Would that still be ok or will it be too early, still a bit confused to be honest (hard headed) on top of that the 28 days before expiration rule still going over my head.

Initially you get 33 months of spouse visa from abroad but you can apply extension after 30 months minus 28 days but by doing this there might be a shortfall arise in future in completing 60 months needed for ILR (it doesn't always happens). Whereas if you apply very close to your visa expiry then usually the shortfall doesn't arise.

I urgently need your help with the FLRM Correspondence documents.

Would the below dates of letters be sufficient, know there is a gap or difference like a month.

Partner document dated:
NOV 2017
March 2018
July 2018
December 2018
March 2019
July 2019
November 2019.

And Me as husband:

NOV 2017
March 2018
July 2018
October 2018
March 2019
July 2019
November 2019.

Please let me know if these would be fine to use or if you could advise me on the alternatives.

I have one document dated: August 2018 will that be ok but only I (the husband) have that month, will that be ok?

And also will having more than 6 correspondence letter be ok to submit?
