FTT appeal allowed. What's the next step?

Dear all

Hope you are all doing well.

My family including my mother, father, my partner and me received a decision from the FTT immigration court after we appealed the HO refusal on Asylum application. The judge's decision stated below:

Appeal refused on Asylum
Appeal Refused on Humanitarian protection
Appeal ALLOWED on Human Rights Ground

We received the decision on 30th Aug 2023. My partner received a letter from the HO asking to sign the declaration for making an application for a biometric immigration document for leave to remain on the 21st Sep 2023. However, till date which is 4th Oct 2023 none of my other family members including me has received any correspondence from the HO. I contacted the court to ask whether there is any appeal on the judge's decision from the HO and they mentioned there is nothing from the HO and that the case is now closed.

I would like to ask how long does it take the HO to grant a leave to remain? How long should we wait?

Also, when we made the asylum application (further submissions), the HO advised that my sister should claim asylum separately in her own name as she was no longer a dependent on my parents. She was at the court hearing as a witness however her name is still linked to the case. Would she also receive a leave to remain along with the rest of the family or do we need to write to the HO separately about her situation?

Any information or advise would be really helpful.

Unfortunately it can take a few months. I had an appeal that they withdrew from and it took 3months for the new decision and BRP to come. Good luck though.

Thank you so much for your reply. Just want to confirm one more thing please, did you receive the biometric card directly or was there a correspondence from the HO where they tell you about the kind of leave you were granted. My partner has only received a letter from the HO asking him to sign the declaration and nothing thereafter. Sorry, just a little worried and curious about the process.

I didn't have an asylum claim so I think the process might be slightly different as I didn't have to sign anything and the HO representative asked to withdraw as my further evidence changed her mind. I received an email with the decision and the grant of leave to remain. The BRP came four days later and I received an email from the courier beforehand. Just hope you and your family receive your good news before the year end.
