Home office needs decree absolute of your fiance otherwise they will not issue COA. Which visa you have?

You need to write to caseworker and explain to them with documentry prove that your fiance will receive decree absolute on September 7, 2010. In the meantime tell them to go ahead with your application. Book your appointment in advance with registry 3 weeks before the expiry of your visa date.

i have sent them today with proof but i dont think you can book in advance with registry unless you show them all the evidence including COA and decree absolute.

Government plans to abolish COA

Post by choc_mouse » Sat Aug 14, 2010 8:10 pm

http://www.ukba.homeoffice.gov.uk/sitec ... oa-changes

The article says the COA should be abolished late 2010/early 2011 because it's incompatible with the European Convention on Human Rights.

Until it has been abolished, the rules remain the same. My fiance needs to apply for one but we might wait for the COA to be abolished as we plan to get married mid/late next year.

Hope that helps some of you if you can wait!

the damn coa

Post by UKgoodboy » Mon Sep 13, 2010 9:28 pm

guys i have applied since last 12 weeks.. absolutely no news... the stories posted here is very hurt aching. could anyone tell me which nationals are first category with shorter wait, and which of them are in the longer list.

after reading all of these, i can't understand what the hell people do in the homeoffice. they suck the money of tax payer with a budget of above 9 billion bloody pounds (go and check urself on wikipedia), they can't even run a call centre.

my experience with calling them was encountering very rude, very impolite and useless people.

UKgoodboy I understand how frustrated you are with the system (see my earlier posts - I went through the same thing).

The only positive advice I can give you is that nobody seems to have been refused, maybe you'll have to wait 8 months like some of us, but we all got it in the end. I'm sure if you have submitted everything correctly you will get your COA.

Just wait til you go through the stress of planning the wedding next lolz!!

Quick question regarding COA and visas guys, im Scottish so havent yet gotten my head round British immigration.

IF my partner comes to the UK with me on a Fiance visa, it states that this entitles her to 6 months and we are expected to marry within this time, however - in the COA regulations it states that a COA will only be granted to those whos visas are for longer than 6 months.

This is a contradiction isnt it?

So, what happens if we come to the UK, her fiance visa comes through and we apply for COA, only for the COA to take its sweet time, all the while she cannot work.... Can she apply for an extension to her visa whilst awaiting the COA or is it a case of go home to country of origin, try again later?

Thanks guys

You have a fundamental misunderstanding! Namely, if someone comes to the UK on a fiancée visa then they do no need to apply for a CoA! Simple as that.

Maybe im missing something thats glaring me in the face here: The fiance visa section says that you generally should to marry within the 6 months...and for that, if your partner is from outside the EEA, you need a COA no?

No! Again, if the person has a fiancée visa then they don't need a CoA.

By that you mean getting married in Mexico? Two advantages in that, firstly she can work as soon as she arrives in the UK, and secondly it cuts out one visa application in the UK, namely the need to convert the fiancée visa into a spouse visa.

exactly, yeah... just seems like the simplest and most financially feasible method. id loathe to get to the UK only to discover a complication or..I dont know, some reason why things cant progress and she be forced to go back to Mexico on her own.

Shes off to fish out my plane ticket, old photos, emails etc as we speak so... we shall see what happens. Shame it all takes 8 or 9 weeks mind.
