hi evryone i have a query here i want to help my friend because she dont know what to do shes with albanian man and he is illegal immigrant here in uk and they live togther they are planning to get settle soon in uk plas tell me if this is the right thing to do my fried is a british citizen ?

How long have they been in a relationship?

Does she earn a minimum of £18,600pa?

How long has he been in the UK illegally?

No options to apply within the UK for a fiance/spouse visa, he will have to return to Albania and apply from there. They are also unlikely to be able to marry in the UK as the Registrar has a duty to report any non-EU marriage requests to the Home Office to investigate, which will flag your friend up to Home Office.

There is no 'easy route'.

Is thre any other option that they can apply here for fiancee visa they went to the solicitor and they had been advice to complte the documents to apply for fiancee visa but friend doubt and shes not sure if the home office aprove the application and also they dont want to pay the big amount of money for nothing and also if ever they apply for a fiancee visa here in uk can this application affect here status as a citizen because shes with the elligal immigrant her bf been here for 3yrs and she only get paid 15thousand p/y???

He can only apply for a fiance visa from Albania, there is no option to apply from within the UK.

She needs to earn a minimum of £18,600 per year, there is no way of getting around this.

The solicitor has given poor advice. He won't be able to submit a fiance visa from within the UK and your friend doesn't earn enough to qualify to sponsor him.

We were told my husband would need to return to albania. The key is finding a different solicitor. We have married in the UK after he was subject to immigration - but know several other people who have married in uk with no previous corrospomdence and the home office have granted them permission and they have not been detained etc.

They should be careful. Once they register the marriage here the Home Office are made aware and even if they don't detain him they will know he is around and could do so at anytime.
Even if they marry here he cannot legalise his status unless he applies for spouse visa from outside the UK, in other words he will need to return to Albania. A spouse visa will over ride the fact he was illegal here as long and as he has no criminal convictions he will most likely get a spouse visa.
Don't trust any solicitor that says its ok. The only option to legalise after marriage here is to apply for right to remain under human rights, article 8, right to a private life.
I tried this prior to marriage to my Albanian husband and it was refused. He has a criminal conviction in UK and was removed back to Albania. We have since married there but its unlikely he will get a visa to join me. It looks like the end of the road for us! Its devastating.
Also, please be very careful, they are notorious for doing this in order to get a visa. I know a few Alb guys here that are married to Brits but have an Albanian "wife". There they just get engaged, not actually marry but its as good as.
