ILR DEPENDENT ISSUES

Post by cpduk » Sun Nov 03, 2019 11:18 am

dear members
I am silent member of this forum. I need advice from you for my dependent application. My husband applied ILR using Set O on Feb 19 and varied to Set LR this month and got approved last week. I applied on T1 Dependent which is still pending now. I am here since 2012 as T4 and become dependent on 2017. I spent more than 6 months in back home hence my 10 years also doesn't apply. At present we are unable to meet financial requirements for FLR M application in next 4 months. I am considering to leave UK upon getting a decision for dependent application and apply from outside uk meeting salary threshold. Now I have some questions:
1. I got advised that HO will give me option to pay IHS and accept 2.5 years visa, is it true?
2. If I vary current application with FLR FP without meeting finance they may approve 2.5 visa but I will be in 10 years settlement route, is it true?
3. If I get 2.5 visa, can I apply for FLR M after fulfilling salary which put me back on 5 years route again?
4. Is there any adverse effects if I leave UK now and apply from outside after 6 months?

Your advice will be highly appreciated. Thanks

Possible. You should have varied your Tier 1 dependent visa when your spouse varied to ILR LR.
2. If I vary current application with FLR FP without meeting finance they may approve 2.5 visa but I will be in 10 years settlement route, is it true?
Yes, 4 x 2.5 year visas.
3. If I get 2.5 visa, can I apply for FLR M after fulfilling salary which put me back on 5 years route again?
Yes, then you will need 2 x 2.5 year visas on FLR(M).
4. Is there any adverse effects if I leave UK now and apply from outside after 6 months?

No.

Dear cr001
Thank you for your kind reply. I am now going to vary current application with FLR FP this week and then I'll go for FLR M later after meeting financial requirements. Could you kindly suggest me what papers I need to submit for FLR FP now? Looking forward for your reply.

1. Please do not dig up old topics to tag onto.

2. Your circumstances are different based on your other post. This users partner got ilr based on long residnece not PBS route, for switch is the only option and a new qualifying period for ilr.
