mistake in application form in spouse visa

Post by pink85 » Fri Nov 17, 2017 7:28 pm

I have apply for my wife spouse visa from india
When I submitted application form after that I realise there was few mistakes..
Example below:
1, given name: priya bhavsar
Currect is priya (my name) bhavsar as passport
2, spouse dob:27/03/2017
Currect is :27/03/1985
3,visa application type: child and other dependent or settle person
Currect is : wife
My wife she gave biometric today in Indian when she ask about that currection they said currect in form n signed..that she did it n they also said send this currection copy with covering letter to sheffield.. still I have to send supporting documents in Sheffield n waiting for her application currection with sign form.
My question is..on this mistake ho can refuse application?
Or
Should I withdraw application n re apply
If I withdraw application can I get refund my fees?
I really appreciate if any one can help me out..thank you

3. (c) in the UK with refugee leave or as a person with humanitarian protection.
E-LTRP.1.3. The applicant must be aged 18 or over at the date of application.
E-LTRP.1.4. The partner must be aged 18 or over at the date of application.

E-LTRP.1.6. The applicant and their partner must have met in person.

E-LTRP.1.8. If the applicant and partner are married or in a civil partnership it must be a valid marriage or civil partnership, as specified.
E-LTRP.1.9. Any previous relationship of the applicant or their partner must have broken down permanently, unless it is a relationship which falls within paragraph 278(i) of these Rules.
E-LTRP.1.10. The applicant and their partner must intend to live together permanently in the UK and, in any application for further leave to remain as a partner (except where the applicant is in the UK as a fiancé(e) or proposed civil partner) and in any application for indefinite leave to remain as a partner, the applicant must provide evidence that, since entry clearance as a partner was granted under paragraph D-ECP1.1. or since the last grant of limited leave to remain as a partner, the applicant and their partner have lived together in the UK or there is good reason, consistent with a continuing intention to live together permanently in the UK, for any period in which they have not done so.
E-LTRP.1.11. If the applicant is in the UK with leave as a fiancé(e) or proposed civil partner and the marriage or civil partnership did not take place during that period of leave, there must be good reason why and evidence that it will take place within the next 6 months.

The OP holds ILR based on 10 years long residence and not PR under the EEA/EU route.

You have already submitted the application so nothing you can do about it now.

Because if you are an EU citizen, VAF4 spouse visa would not be correct and as you and user 'verti' keep saying PR, I was merely stating the exact route you followed to ILR as the ILR and PR routes have very different requirements and rules.

I will leave others to comment further if they choose to.

Good luck.

Thanks cr001 ...I understand different between 2 word differences now.
And on my case someone said u can still write covering letter if u did mistake or something wrong going on until ur application is pending.

My opinion I did write things but now little bit confusing on 1.5 and 1.15 (if I do cross check) like relationships begin n outside marriage relation

Anyone filled vaf4 recently and arrange marriage in Hindu culture ?

5 years route or 10 year rout to settlement confused

Post by pink85 » Sat Feb 17, 2018 8:59 am

My spouse visa(settlement)approved from 15 feb 2018 to 15 nov 2020
I applied spouse visa with financial requirements met( 6 month category A)

On page 2,

- (Non-Standard 1) - because you satisfy the requirements of paragraph GEN.3.1. of Appendix FM: or
- (Non- Standard 2) - because you satisfy the requirements of paragraph GEN.3.2. of Appendix FM

it means that you are currently on a 10 year route to settlement. If you continue to meet the requirements and make the appropriate application for further leave to remain, you are likely to be eligible to apply for settlement in 10 years. If you are later able to meet the requirements and make an appropriate application, it is open to you to switch to start a 5 year route; however, time spent on the 10 year route will not be counted towards it.

What that mean my wife eligible on 5 year route or 10 years route for settlement?

This is is normal standard latter?

I am worried for settlement route..
Cr001?
Anyone recently got spouse visa?
