My wifes Visa curtails in 8 days

Hi everyone.

Hope your well. My wifes Visa has been curtailed to the effect that She has to voluntarily leaves or makes another application before the 26th of may. She went to Pakistan beginning of April. Is she allowed back to the UK this week, say tomorrow(18th may) and leave before the 26th may? Or has her Visa ended and now she has to apply again from Pakistan?

What visa does she hold and why was it curtailed??

She should not have travelled out of the UK while her visa is curtailed.

She holds a spouse Visa. Curtailed because I told the home office that I've separated from her. We had some big time issues.

Could she come back tomorrow to the UK? would the immigration be ok for her to enter UK and then she could leave the UK before the 26th may?

What is the purpose of her returning to the UK??

The IO at the airport will see on the system her visa is curtailed etc.

Well her reason is to see me tbh. But I'm in Glasgow and she is arriving at London to see some family. Will the immigration allow her entry to the UK?

According to my understanding when the home office make a decision that her Visa has been curtailed, it just means her Visa has been cancelled and she is not allowed entry to the UK until she re applies from Pakistan again. Is my way of thinking correct? Or is she able to apply from the UK bearing in mind that the expiry date for the curtailment is only 8 days away. This is all so confusing for me

Your wife now has no valid entry visa for the UK. It's irrelevant that she chose to leave before the curtailment date.

If you restore your relationship she will have to apply for a new Spouse Settlement visa and start again from scratch.
(Casa, not CR001)

I know that I'm trying to see some light and think positive. If she was to get to London Heathrow tomorrow, will the immigration arrange for the next earliest fight for my wife to get back home? What would be the process of immigration?... I'm assuming that youve come across many similar cases to mine. Thank you for taking time to answer all my questions.

Correct. Pakistani immigration authorities will definitely trace it and won't allow boarding. She will have to re-apply spouse visa once again.

I always advise colleagues to be careful not to take important and life changing decision in a hast . No matter what, there is no gain requesting for curtailment. I understand something its difficult but always fine a place in your heart to forgive.

How will Pakistani emigration know that her British visa has been curtailed? They do not have access to UK immigration records on a routine basis. They will go by the visa vignette in her passport. If her visa vignette still suggests that she has a UK visa, Pakistani authorities should allow her to board the plane.

She will almost certainly have issues at the UK border.

Even by miracle she succeed to board the flight to UK but will be sent back maybe with 10 years of ban and plus might be charged again in Pakistan on account of deceiving to immigration authorities.

Pakistani immigration authorities check the visa on a scanner to verify and I am not sure if something might pop up on the system that the visa is not valid/genuine.

Hi Guys...

Thank you for all the help. My wife did make it to London Heathrow but she got denied entry as there was no valid UK Visa so they detained her and deported back to Pakistan on the next available flight. Because she still had a valid brp card, Pakistan immigration did let her go through as the brp card does not flash anything on their systems.

So my question is... because my wife was denied entry to the UK as she had no valid UK Visa and she got deported. What's the chance of her coming back to the UK within a year if she re applied for the spouse Visa?

That's why advice was given above that she can be deported back. Now all future applications applications will adversely be affected.

I think it’s best to see a solicitor at this juncture.

When you asked home office to curtail her visa, was she given a chance to appeal the curtailment? Also, how long did the Home office give her to apply for another visa?

Visas are curtailed to 60 days. The ops wife visa expires on 26th May which is the end of the curtailment period and new expiry date.

The letter says that she can not appeal. It did say that she has up to 60 days to either leave the country voluntarily or apply for a new Visa before the expiry date. She came to London airport and found that her Visa is cancelled and they then deported her back on the next flight available. As she has gone through this deportation process, do the immigration at London put a ban on her file for a certain number of years or can she apply for a spouse Visa immediately. She wants to continue her studies too so if she cant apply for a spouse Visa at this point, could she atleast apply for a student Visa?

When did she fly into London?

My question is: Are you separated now? Divorced? What are your plans? As you mentioned, you yourself reported to HO about the separation which led to all this.

She may even be charged with deception too as she was already knew regarding her visa expiry. Not sure what pakistani authorities on arrival will treat this issue.
