Overcrowding? Visa for new born

Post by jazbaati99 » Tue Dec 12, 2006 11:43 am

Dear all

I am about to apply a visa for my new born son from Pakistan. Myself and wife both have ILR. A slight concern, I have a two bedroom flat, my sister (21 years of age) and a masters student is living with us at the moment.

Do you think it can cause an issue of over crowding for baby's visa?

Any response is highly appreciated.

Indeed correct ... click here ... where you will see it is more complicated than merely counting the number of bedrooms.

Many thanks for the link John. Having read through the guidance notes, it does seems that I should be ok as babies under 1 years old are not counted. I guess I am being a bit paranoid (don't want to leave anything on chance as the application turnaround from Islamabad is around 3 months) but can you kindly confirm that I should be ok?

Many thanks in advance.

So how many "counting rooms" have you got? I think you should not just assume that you will be OK because the baby under 1 does not count, because the place may already be classed as overcrowded!

As necessary grab a tape measure, and excluding any Spam, bathroom or toilet, whatever their size, how many rooms exceed 50 square feet in size?

Surely u can't count an entrance hallway! I have a garage attached of well over 50 sq ft but I wouldn't expect anyone the sleep there.

Wanderer, I agree that the hallway cannot be counted, simply because it is not a room, but a passageway leading to room(s).

But with 3 "counting rooms" that is OK for up to 5 people. And you only have a count of 4 people living there.

So document this and include it with the Child Settlement visa application.
