No, I think. They asked to fill some details like Nationality, Religion, Marital status and so on apart from the one you mentioned. There were around 20 questions in a separate questionnaire form. I just sent it today. This time they asked to send to bit different address as below.'First-tier Tribunal Immigration and Asylum Chamber, PO Box 7866, Loughborough, LE11 2XZ'

Hi All,

After months and months of frustration, last Monday 9 - Nov - 2015, we got an email from the Global Appeal Team that the decision is overturned. They mentioned that, Chennai BHC will be in touch with us to collect the passport. They said it will take few weeks. We are still awaiting to hear from the embassy. Good luck Mariappan and others who have appealed.

Congrats Vanakkamchennai! Finally things are going in your side. The efforts you put are much appreciated.
I just enquired about my status at https://ukvi-international.faq-help.com. But they asked me to contact tribunal. How come tribunal can answer my status as it's currently with Chennai BHC. Please help me how to get the status update from them like how you contacted them other this route. I have to come out of this frustrating visa issues.

Thanks & Regards,
Mari

Hi Mariappan,
Today, we got the email from Chennai BHC to submit the passport and TB certificate. They advised no need of new TB test as the existing test is valid for 6 months. Hope all goes well. Fingers crossed.

The status after sending the letter of pending appeal is a bit grey. This is what happened to me. Tribunal said they don't keep the status. Chennai BHC is contacted only through faq system, which we contacted twice. Both times they said the case is escalated. First time they came back telling they didn't receive our application. They didn't come back on the second time. In between, we called the number mentioned in the faq website and they said they address only general enquiries not any tracking information.

I see you received letter of pending appeal on Oct. 27. Mine was on Oct. 12. I received the decision on Nov. 9. So I expect your case response by either this week or early next week.

I found an email address for Chennai in today's email that we received, which is Chennai.Visaenquiry@fco.gov.uk. Check if they provide the status through this email.

And in the letter, it has one more email address for enquiries. Try this as well: Chennai.SingleTierEnquiries@fco.gov.uk

Also one more update. We got our decision from Croydon office, which makes me think, will the appeal bundle really goes to Chennai?

I see people are getting good response if they contact the local MP. Make a visit to your local MP's office and submit a complaint.

All the best. I know how much would be the pain in getting this done. The new applications are now processed in 16 days in Chennai, which is shame for home office on their poor appeal timeline for review. Tell your wife to cooperate. You are not far away from getting the good news. Take care.

Hi Vanakkam,
Congrats again! This is a great progress. Hope you would have sent the passport and you will get the visa soon.
Yes, it’s interesting that you got decision from Croydon. Not sure where they are really sending. But they mentioned they sent letter to embassy where I originally made application in their latest letter to me.

You said your case was escalated. But I got the below response when I asked them to give status of my wife’s application with GWF number. I selected the option of asking for status with GWF number and DOB. How did they escalate your case and how did you ask them? Your response will be great on this. And I am going to send mail to the ids you gave as well.

Hi Mariappan,

They mentioned the same in my letter as well. I believed that the application will be processed in Chennai. But atleast in my case, it was not the case.

Ask Tribunal to obtain the status for you. Also send an email to the Global.Appeals@fco.gov.uk (where I received the overturn decision) and ask for the status.

I really wish your decision is overturned by the earliest.

Today we got a call & email from Chennai BHC on our IHS payment.

Here I am copying the exact email that we received.

-------------------------------------------------------------------------------
Name: XXXXX XXXXX
GWF reference: GWFXXXXXXX

Immigration Health Surcharge (IHS) payment needed

Please be informed that you need to make IHS payment for your current application.

In order to make your IHS payment, you must now:

• create a fresh application via www.visa4uk.fco.gov.uk and make the IHS payment as part of that process;
• no need to pay visa fees;
• once you have completed this process please send an email to chennai.ihs@fco.gov.uk containing your name, the two GWF references (old and new) and the IHS reference number so that we can incorporate your IHS details to your current live application.

Please note that if the new application and payment is not made by 1/12/2015 then your application will be refused. If this is the only reason for refusing your application, you will have to make a new visa application and any new visa fees will not be refunded.

To prevent any further delays with processing your application, once you have made this payment please send an e-mail to chennai.ihs@fco.gov.uk containing your name, GWF reference and the amount that you have paid for IHS.

Want to find out more?

To speak to someone about this, please visit: https://www.gov.uk/contact-ukvi

To find out more about IHS: www.gov.uk/healthcare-immigration-application

To find out about refunds: https://www.gov.uk/browse/visas-immigration

Thank you.

-------------------------------------------------------------------------------

One word of caution is, while making IHS, in the first attempt, I have added my details as a sponsor, and as soon as I add my ILR expiry date which is somewhere after 2020, the system asked us to pay INR 1, 57,000 (£1500). I saw no way of reducing or modifying it. Later I created a new application and in that, I didn't add any UK sponsor details. It then asked to pay INR63000 (£600) which is correct. So anyone makes IHS payment through this method, please be careful.

Dear Vannakamchennai.

Thank you so much for your post and replies. Your experience and support to the others has given me courage to consider the appeal.

Dear Mariappam, all the best to you for a speedy result. Do keep us posted on your progress.

Dear Powdra, what decision did you take and how are things moving in ur case.

My wife applied for a spouse visa at Delhi BHC 19 Oct and on 19 Nov she got a refusal. The Letter reached us today.

I am naturalised Brit and sponsor to my wife.

The grounds of refusal were insufficient evidence documents to meet the financial requirement. I have a limited company with morethan sufficient earnings operating for more than 2 years.
Appendix form 2 was nearly missed by me as not mentioned when filling in the online form. I submitted docs but some.documents did get missed. Thought they would request any they needed and I could oblige. Some of them were even on the regulating body's website available publicly but the ECO didnot ask me or look them up as per appendix FM-SE. Infact my business bank accounts seem not to have been taken into account (probably as online docs but then I have a paperless account).
My personal accounts not taken into account despite orignal savings annual statement as well with sufficient funds.

They even had the cheek to suggest we could contiue our family life by me continuing to visit her if need be in a 3rd country.

Wondering if I should appeal given only docs needed which I can supply or reapply?. (Both seem to have take about 2months and not sure how a visa refusal may affect her career. She is a doctor)

Also did u guys submit any originals as additional evidence during the appeals process. (I understand they want photocopies only). Would they want any docs they have already accepted or only docs to help satisfy points of refusal (I take it you submitted as many docs as possible right?)

Looking forwards to hearing from you guys.
Best Wishes

Hi Nihcas5

I am very sorry to hear that your wife's visa was refused.

Actualy, the information about Appendix 2 of FM-SE is displayed as a note while applying online (I guess in first page when you select the releationship type is Wife, and Visa type is Settlement). I read in one more forum (http://www.immigrationboards.com/immigr ... 89684.html) that a person has missed submitting Appendix 2.

How could an immigration official suggest anything like this:
"They even had the cheek to suggest we could contiue our family life by me continuing to visit her if need be in a 3rd country."
This is inhuman.

If you appeal, don't submit any originals. They ask only photocopies. I have submitted all the documents in the appeal thinking the case worker will be a new person and always can have a fresh look if all the documents are there.

Keep us posted on what you decide.

All the best.. May all goes well on your favour and you get united with your wife by the earliest.

Hi Nicha5,

Sorry to hear that your wife been has been refused. All the best for your appeal! Sure, I will keep posting if there are any update on my appeal.

Hi Vanakkam,

Great progress from your side! All the best and you will get your wife’s visa soon. But do we need to pay IHS for settlement visa? If that’s the case why they didn’t ask us during our original application?
From my side, I don’t have any update till today.

Hi Vanakkam,

Well, they didn't ask my family to pay IHS when the made their original application(July 17th). Even Chennai VFS people said while making application, we will get mail from UKBA if we need to pay IHS. We never got any mail on IHS. Not sure now, whether they changed the rule or not.

This is the standard reply.
Contact George Osborne, head of immigration by email. His two email addresses are available in UK parliament website.

In my case, I didnt receive any reply for my first query, and then send a reminder a week later and they forwarded my request to the home office and later I got my reply.

Hi Vannakkam, Mari

What did you guys put down in reasons for Grounds of appeal - human rights claim.

What about documents they may have wanted in original (as we have to send photocopies only) e.g. I got bank statements signed and stamped.

George Osborne is the First Secretary of State to UK and I think in one of the correspondings from the Home office/Tribunal, they mentioned to me that, that the secretary of state has refused entry clearence to your wife, and that made me to email him. It was just an attempt instead of doing nothing.

Nihcas5, yes it is human rights ground for me, which was mentioned in the refusal letter.
I didnt send any original documents, and none of them were authenticated with the bank.
