I lodged my husbands appeal on the 11th June, got a response back from them on 13th July saying the appeal had been lodged, and that the ECO has until 24th November to decide. This is over the 19 weeks they state, but when i contacted them, they say they give a few extra weeks for post.

I am also sick of waiting, and it annoys me that you cant make any plans at all.

it was rejected because we had not given an explanaition as to why a single man would want to marry a divorcee with three kids so they thought we was not asuitable match in regards to an arranged marriage.ours wasa love marriage which was clearly stated in our application. also they miscalculated my earning s only took in one months wages and didnt bother with the rest. iv just paid out 900 to a barrister who just keeps telling me to be patient and is convinced it will go to a judge who at this point i then pay another 700 to him for court charges what a joke. gonna go gym or something to get my mind of things

i cant help but to wonder if these officers put throught their personal opions on the visa applications, and thats why some are rejected. With yours they have clearly not even read the information you supplied to them.

i hope you have written all this in your appeal letter.

The ECO made a comment that he can not see that rejecting the visa will interfere with married life, as we can continue to do this in India, dont know if they are stupid or they want me to leave my place of birth and move to a different country.

Hiya people,

I have been following this forum for a few months now and never posted before. I thought I would let everyone know how I have been getting on with things.

I am british born and have married a girl from India who is an Indian national.

I have not used a solicitor for the application or the appeal but have consulted one for advice only.

My wife applied for her settlement visa on the 10/04/2012. We received confirmation of refusal on the 07/07/2012.

The sole reason for refusal was that we did not enclose the original registration of marriage certificate in the application so they are not happy that the marriage has been legally registered in India. It is my own fault as I prepared the application for her and I cannot read Gujarati I must have missed it, the notary translation was sent though.

It all seems pretty straight forward, we have to send in the original certificate and chances are the decision will be overturned upon review. The ECO could very easily have called my wife and asked her to bring in the certificate.

The appeal was lodged with the Tribunal Service on the 17/07/2012, after numerous phone calls and complaints regarding the length of time the appeal is being held up Leicester we received the letter from them on the 23/08/2012 confirming the ECM has till 03/01/2013 to review the decision.

I totally sympathise with others who are in limbo and cannot do anything other than wait.

By sending a complaint in writing to Leicester sped up the process in them sending the documents to the embassy in Mumbai South. I would suggest that for others who are still awaiting their appeal documents to reach the embassies.

Anyone have any ideas about how to get the embassy to speed up things in processing the appeal????

Mine seems a very straightforward case as all they want to see is the original registration of marriage certificate which we have now sent!!

I know Harpreet managed to get her case looked at quickly by contacting the embassy in Delhi directly!!

Any suggestions would be welcome people!!

well my lawyer has said its a baseless allegation and completly insensitive. well i wish they went to specsavers and got thier eyes tested coz they cant read

You don't have to be worried as the status did not change for me from "forwarded" until I collected my passport four months later...

Hi All,

My wife applied on 11th June settlement visa and we still havent heard anything yet. anyone in the same position applied from delhi VFS?

The stories of rejection are dreadful, I cannot fathom how one is justified in rejecting a visa based on 1 -2 single documents not being submitted, when everyone knows the list of documents to be submitted is endless( the more the merrier being the case)..are they not increasing their own work?

How hard can it be to make a single phone call and ask people to turn up with the document?

I've spoke with few people who have advised me of the process.

It doesnt matter whether you applied in Mumbai South or North, they are just the VFS offices. VFS involvement in our cases stops as soon as our documents are returned to us.

All the applications will be processed at the nearest British Embassy which in our case in Bandra in Mumbai.

As soon as the First Tier Tribunal Service send the documents to the embassy they are normally just sitting there till about 2 weeks before the date given to them by the Tribunal.

They only way to get the embassy to look at the case quicker is to give them a reason to actually find our particular case and llok at it early.

For example in my case say i needed the original registration of marriage certificate back for another matter. I can request the embassy either in writing or by email to consider making the decision early. They would only do this if it is a straight forward case.

You can further reinforce the request by going to your MP and they also request an early review seperately.

It all comes down the ECO individually and they are normal people just doing a job so if it's a reasonable reason they would look at it early.

What im not sure about is if i needed a reason to request the original certificate, what other reasons in India would you need to produce a registration of marriage certificate???

can anyone advise me howi can get the tribunal guys to sen my appeal any quicker i have a letter from my docs stating that i am under a lot of pressure and stress and she has now put me on treatment for this. will this help them to sped up the application

Have u received your 'notice of pending appeal' yet?

If you havent then i would send a letter of complaint to their address in leicester complaining about the length of time it us taking!

I sent it registered post, they received it next day and complaint was logged onto their system the same day. I received the letter within 4 days. The advisor told me when u make a complaint their team manager sends an email to the dept that prepares documents to be sent to the embassies. They have to take priority.

You seem to have appealed same time as me so should be very soon. Your medical condition makes no difference to them, as far as they are concerned you wait ur turn like everyone else. I complained because every advisor i spoke to gave me different time frames, one would say it would be sent in a week another would say two weeks and 3 weeks later i was still waiting. Also remember you now pay for the appeal and we expect a certain standard if service from them.

Is it ur application or are u then representative for the applicant. Only the appelant, representative & ECO get the letter. If you are India then it will obv take longer to reach you by post.

oh god feel far to scared to complain case something gets delayed delibrately. im in the uk its my husband whose visa is the prob. my lawyer just says be patient and refuses to submit any more evidence almost as if he wants it to go to court. seriously thinking of changing solictors.

They put my wifes appeal on their system on the 01/08/2012. After that they await confirmation that the fee has been paid and after that another department gets all the documents (including any new evidence submitted with the appeal) ready to send to the embassies. That is the stage you are at, it can take anything from a week to a few weeks.

It should be soon though.

Also you will receive no information regarding the appeal as you are only the sponsor, only the representative gets copies of everything including the letter. I believe from reading your previous post that you have a solicitor acting for you, he will be your representative so he will receive ALL paperwork. He will also want to take it to a hearing so he gets paid for more.

This is the reason I dont like solicitors, I would only use one if after the 19 weeks the ECM upheld the original decision and decided they still dont want to issue the visa.

Your solicitor should hopefully receive the 'notice of pending appeal' in next few days.

hi just wanted your advice on something god forbid that the ecm does not respond back and asks for it to go to a immi judge, woukd you suggest i make a trip to india beacuse the refusal reasons were genuinity of relationship. Im finding it hard to get time off from work as i have used all my holiday up and will get it again in Jan possibly. i hoping that if it does go court that the judge doesnt question why i didnt go to see my husband after the refusal.my main reason for this is no time off left from work
