Settlement visa application from India - 2011

couple of queries:

1) when UK sponsor is flying to india for marriage - does UK sponsor need to submit passport copy page showing india entry stamp or not mandatory as marriage certificate there?

2) if UK sponsor changed his job 2 months ago but earning £45k+ does UK sponsor still need to submit 12 months pay slips and bank statements or 7 months will suffice

- Regarding your first query, I would say full copy of passport should be submitted and this should preferably be a notarized copy. there have been few cases of rejection where this was not submitted.

- On second query, Yes, more so in your case. If you have been with the same employer for over six months earning the same salary then last six months salary statements and bank statements is sufficient. If there is change in employment or salary level (even due to promotion) then the full 12 month salary statement & bank statement must be submitted.

Most importantly, the net pay in salary statement should be the same as bank statement. If you were paid back travel expenses or other work related benefits, this must be explained with a letter from the employer.

Hope this is clear.

can you kindly explain why the application was rejected? what reasons were stated?

i) VFS took my passport copy but didnt take the immigration stamp page and gave it back saying no need?

ii) changed my job a few months ago so didnt know about the 12 months pay slips and bank statements hence only submitted 6 months pay slips and bank statments? showing £45k salary

iii) is there a chance application will go through or get rejected? or will BHC contact us to provide additional documents??

iv) the application is still under process is there a chance we can send these documents to BHC now?

@Aishpe

Your husband's passport copy and a copy of all the visa's to India should be provided to support your applications. Especially the visa used to go for the marriage.

There was a refusal quite recently because the visa was not there to support evidence of your relationship.

For such cases if the visa gets rejected - is it best to appeal or get all the documents and apply as a fresh one??

I notice on your visa application details that ECM to reply by april seems like a very long time to wait for the appeal??

You can appeal... and if you have the money to reapply - you may do so.

I applied in april
visa rejected in july
appeal lodged in july end
appeal received in sep
appeal allowed in dec
visa granted in jan..
Its wz a long long waiting game.. everybody who applied n appealed keep patience..
N who r applying submmit all documents perfect..as its should be no chance of rejection..

May I ask what was the reason ur visa got rejected? and what documents did u provide to appeal??

Well, despite the option to appeal, my husband and I have decided to re-apply.
Thank you Batleykhan for all the feedback. Based on the advice we have received on this forum and from solicitors and other immigration experts, we felt re-application made the most sense for us. Quite apart from everything else, we do not have the patience for a lengthy appeals process. This time we shall make a foolproof, watertight application and pray for it to go through speedily.
Again, thank you for all the help. I will re-post when we have filed a new application.

Good news, my wife's visa has been approved at BHC Mumbai

Timelines below
30/11/2012 - Application submitted at VFS Mumbai
03/12/2012 - Under process at BHC
11/01/2012 - Visa processed and sent to Blue dart
12/01/2012 - Visa granted till Oct 2015.

Your very lucky to get the visa so quickly.

Dont understand why it takes them so long for some applications and quickly for others.

Keep me in your thoughts and hopefully my wife will get her visa soon.

when you got rejected once and are reapplying for settlement - in the application form..where it's mentioned have you ever been refused a UK visa in the last 10 years? do you have to say yes or no?

It is self-explanatory. If you have been refused a visa in the last 10 years, you say you were refused a visa in the last 10 years. Give them the details as well. Please do remember that your previous refusal will be in their database, not to mention the little stamp in the back of your passport. The best thing to do is to address all the reasons you were denied a visa before, make a watertight application, and pray to God they do not find new reasons to refuse you again.

yes, this was a settlement application .... and I am an Indian National on ILR ....
