please can someone adv, is a person is an overstay do they automatically get a 1 year ban thats what i have been adv by a immigration advisor. does this ban apply even if the person left the uk at their own expense and of their own will.

as far as i know if u leave even on ur own expense its 1 year ban(that doesnt apply to settlement visa category like spouse visa but obvioulsy the ECO does scrutinise such applications more)..
if the UKBA paid for ur voluntry return the ban is for 5 years..
if deported its for 10 i think..

Lot of people on this forum think that delays in processing spousal visas are unreasonably long then why not get a PETITION going, everyone signs it and hand copies to your MPs and the original to the Home Office.
If the targets are not being MET then people are justified in complaining, just be at peace with each other on here and get to real work.

Yeah gud advice.

But how it can be turned into a fruitful thing? I mean is there an example like this in past? I am definitely in if some kind of activity is planned like this

I have been on this forum for just over a year now. My Husbands application was refused. We appealed and I went to the hearing by myself infront of the judge and put forward out case.

Alhumdullilah the appeal was accepted and Visa granted.

I pray for all those waiting that they are granted the Visa first hand as believe me appealing is just another hurdle that you can do without.

Hello. I know one member here who spoiled for spouse visa he was an overstayed and worked illegally but got a visa.
In my case my hubby was an over stayer and was sent back by ukba he was told to apply from there. But nothing about him being ban was mentioned. We applied for spouse visa it got rejected but that was because he gave ruksati date and gave nikkah form with different date. That was there only issue. They haven't mentioned anything else.

I contacted my mp the immigration advisor stated because my husband was overstay he is automatically banned for 1 year and the mp does not have any jurisdiction to approach the ukba in pakistan as he can only help if the case was being processed in the uk.

How did he go back with ukba or did he buy his own ticket. On my hubby's paperwork all it said was go back home and apply spouse visa the correct way. That's what was stated and my hubby was told that his old case will be closed and then his spouse visa application will be a new case.

He went back on his own accord, at his own expense. ukba just sent him the decision letter in october and he left in november

first off uve submitted ur app u cant really do much now, secondly if ur husband came back volunterily on his own expense and u've submitted all the other documents according to UKBA requirement u'll be ok. thay can not refuse a settlement visa on the basis of overstay, and a ban does not apply to such applicant.

the ECO will look at his history in UK i.e work, education if he studied etc if his record is clean and he hasnt been a burden on the benefit system that will be a positive point towards him getting his visa.,good luck!

Syma is right you have handed in what you needed to. So just sit back and see what happens there's no point getting an mp involved yet. Just wait and see. You might be very lucky. Spouse maybe looked at diff I.e. Can you support him. Have your own place ect ect.

I know I cant do anything, I was purely asking for information, Im not being impatient and not really bothered how long it takes just wanted to make sure the information I was given by the immigration advisor was correct.

My Husband has just handed in his passport last work 31st of May.
I think UKBA messed up somewhere because the hearing was on 25th April and we received the report from the tribunal on the 9th of May.
But we had not received anything from UKBA ie the "Call in Letter".

We emailed a couple of times and we got a response to say that they wanted us to scan and email them a copy of the report from the tribunal with the decision. After doing that we were both sent a copy of the Call in Letter to our emails.

Going by my case. They didn't do anything with hubby passport he didn't even realise any immigration officers went with him as he sat alone. Only once in Pakistan he saw the two ukba guys there with another Pakistani lady. They handed his passport and paperwork to the immigration guys there, as he was my dad's mate they just gave him his passport just entry stamp on it and he was free to go.
But let's see what comes back or if they have any other rejection or just overturn their decision. I don't know with me having a baby too they said he can reapply easy from there and no ban.

Syma,

Last year towards the end, the ECMs had less appeals to look at hence the response time was about 10 weeks after the deadline was given, in other words about 2 months before the deadline end. But as you know, this is a hugely busy time for them, so I wouldn't expect a quick response at all. If anything you're more lucky, yours has gone to ISB, less applications dealt with there than in Abu Dhabi.
