bro appeal!
i applied in Nov 2008 after getting married in June 08, in Jan 09 it went into appeal, i submited more docs within the 28 days limit only to get a hearing in Oct 2009, mashalah we won, and we are almost coming onto Jan2010, and she has stil not recieved the call in letter! what are these morans playing at?? messing with our lives they think its a bloody game! whats ur story bruv??

They take the mickey out of us but what can we do, my mrs application got rejected on wednesday 16th, she has posted me the papers and we will appeal from england, will let you know the exact reason as soon as I get the papers. They have rejected quite a few people I know of because of some very silly reasons.

Lets pray that we all get good news soon insha-allah..

yes please do keep us updated i got my mrs to email me the papers from the city cos in the pind theyl be lucky to even get a radio signal with all the electric going! But from the top of your head have you any ideas or doubts of why it has been refused? Yes i applied in uk too,dat Loughborogh address i think it was,details should be on the letter also get advice from the iAS.and make sure you opt for a oral hearing. Chalo we wil make dua4u brother

Settlement Visa

Hi there my wife appliied for a spouse visa in Karachi on 30/10/09 we have not heard anything from them yet the website just says application forward to Islamabad OC. can anyone tell me how long this will take and also i have not provided a home inspection report instead i have provided a plan for the house would this affect my application

Hi Suleman,

The application takes about 12 weeks, 3 months. If you are lucky they will have a decision for you within that time a little bit quicker.

The tracking page will remain with Forward Islamabad until a decision has been made, it will then change. So im afraid for most people it says forward on for a while.

As you applied similar to me in October/ November, with the will of Allah we will have good news in January/ February.

hi everyone

can anyone tell me if they know how long it takes for gerrys to update there ssytem once they recive the passport. I recived a email from an Entry clearance manager at BHC Islamabad telling me my husbnads passport was with the visa writer and that he ahad asked them to stamp the passport and send it to Gerrys this afternoon. Iam wandering when it will be ready to collect?

By the grace of GOD my hubbys status changed today after exactly 6 mnths of waiting. I already know that he got the visa as our MP told us in October.

sahsi im so happy for u btw you will know me as samursaleen on the other forum, im delighted for u after waiting you must be overwhelmed with emotions, imstill waiting after 6.5 month pls pray for me that we hear something soon too.
also today i decided that im going to go too see my wife agn, as i cant wait any longer for these eco too process the visa, missing her too much. booked the tickets today with pia for 6th of jan only 2 weeks too go!!! cant wait to be reunited !

Off the top of my head my Mrs told me it was something to do with phone cards, and the that we didnt send the house report which infact we did, so will let you know as soon as I get the papers, am going to appeal through my solicitor, is this the best way? Thanks for ur duas, insha-allah we all will have good nes soon

Hi there,

im reaplying for my wifes settlement visa. My employer wrote me letter stating that my income is approxiametly £452 per month. I get paid forthnightly of 225.13 a week.

the approximate 452 figure was cummulated by adding 4 weeks wages 225.13 x 2 = 450.26 ( figure few pounds short due to tax) this is not exact because most months have 5 weeks.

On the VAF4 form it states what is your monthly income do i put £452 or should i put the following

i.e if i get paid every 2 weeks then i will get paid 26 times in a year hence

26 weeks x 225.13 = 5853.38 per year

5853.38 / 12 (months) = 487.78 rounded off to £490.

Therefore my exact monthly income is around £490 Pounds per month. Do i put the approximate £452 pound figure which was written in the letter provided by my employer or should i include the £490 ?

p.s - Along with my employment income i receive rental income therefore my income is sufficient to call my wife over.

If you are sending your P60 ( which I strongly advise that you do) then you put down what your employer has put down in the letter.

The P60 will show your accumilative yearly pay.

If you are going to include the rental money you get from your property, I hope you have declared that to the Inland Revenue and have paid tax on it, otherwise you are going to get yourself in a very big mess for the simple reason that not to many people declare this income to the Tax man :D

If on the other hand you dont declare the rental income, I am afraid that your wifes application may be refused on the grounds that you do not have sufficient incoming coming in ( Remember you need some thing like a minimum of £105 per week to support yourself and your wife)without you turning to claiming benefits . If you take £420 out of the £452, you are not going to have mucjh left over are you????? :cry:

I finally recieved the refusal papers today this is what the papers said.

You state that you travelled to Pakistan in April to May 2009. Your passport does not show that you travelled to Pakistan since 2006. You say you keep in contact by telephone, you have provided phone cards as evidence of regular contact with your sponsor. However these cards have no name or personal details on them and so do not demonstrate who purchased them or whom they were used to contact. Also I am aware that these cards are readily available in Pakistan to purchase second hand. On the evidence before me I am not satisfied that these cards were used to contact your sponsor. Save for these phone cards you have not been able to supply any evidence of contact with your sponsor. Therefore on the balance of probabilities I am not satisfied that your relationship with your sponsor is subsisting or that you intend to live with your sponsor. Paragraph (iii) HC395

Your sponsor has not provided any evidence that he occupies the accommodation where he resides. Therefore on the balance of probabilities I am not satisfied that you meet the requirements of paragraph 281 (iv) HC 395

I am satisfied that you meet the requirements of paragraph 281 of the Immigration Rules, except for the following: (iii) and (iv) and therefor refuse your application.

Thats the exact words of the letter, any help would be appreciated.

I did send a accomodation report and a years bank statement which are proof enough of residence, I think.

Also i travelled to Pakistan on 18th Feb 2009 and came back on 18th May 2009 so where did they get that from.

After waiting 4 months since i submitted my appeal to BHC london. They have finally told me the original refusal has been maintained this SUCKS. I am absolutely devastated and have never come across this type Bullsh*t in my life. I sent them more than enough proof all my accounts self assesment dads mortgage papers literelly the works. Uncle Batley Khan what is the next step???????????????? Do i contact ait???? im going pk in jan do i re- apply??????

Hi Mohammed,

as there was a gap between your last contact with your wife and your application they needed to be satsfied that you did have contact, did you send anything or make any calls which will show records.

In relation to the other points you could submit a new accommodation report but act really fast. it must state you occupy the property.

If you submit the above with the appeal papers you wil have a good chance it will be reviewed. You will have a good chance.

The reasons for refusal are petty and i think you will be ok if you can prove contact.

Hi RM786.

Sorry to hear they are still not willing to overturn the decision. The next step is to let it go ahead to a full appeal hearing, where I am sure the decision will be overturned.

Just sit tight and wait for a hearing date that AIT will try and sort out for you.

Normally takes 6 months from lodging appeal. As 4 months has already elapsed, its not long before you will get hearing date.

You will need to seek the advice of a solicitor, unless you want to represent yourself at the hearing.

I would not reapply and pay full fee and wait a further 3 months to see if the outcome is different. Wait for the hearing.

Also dont worry. What has happened to you is not unusual. It happens a lot. Inshallh I am sure you will succeed.

Hi Mohammad

You are not from Batley by any chance?

Mohammad if you have read my earlier post somewhere here, You will see that I pointed out the disadavantages of using calling cards. The ECO has pointed out the reasons why, these cards are not acceptable.

I am afraid unless you can provide evidence of how you kept in contact with your wife, its going to be difficult.

Did you send any hand written letters, emails etc?. What about sending her money?. Have you got receipt for it. Things like these will do.

As far as your acommadation is involved, beside doing the report, did you send any proof that you actually own it and live there ( eg bills etc)?

I emailed the abu dhabi team below is the reply i got from them can anyone help me how long does it take for the passport to come back after the email i have recived

Hi guys an update from the Gerrys website under latest news.

21 December 2009: Update on settlement application processing times. The UK Border Agency is now pleased to inform customers that the backlog of settlement applications has been reduced. Most settlement applications will now be processed within 12 weeks.

i have received a email from the UK Visa section;

A decision was made on this case on 14th December.Gerry's will contact the applicant when the passport is ready for collection

How long will it be before this is so any intimation of whether the application is successful.

Hi there,

I will be resubmitting my wifes settlement application next week for the second time due to a refusal earlier. This is the contents of my application will you please confirm that i have gather everything before i send the paper work off

-Completed Vaf4 Form
-Letter of Rerpresentation from my solicitor addresing the reasons of refusal last time
-tenancy agreement for rental income
-Projected and actual acocunts for rental income
-6 months wage slips
-employers letters
-6 months bank account statements
-House survey report
l0and registery deeds for my property and my parents confirming ownership and mortgage free
-letter from parents stating i can stay with them rent free and so can my wife
-p60
-wedding photographs and some photographs from 2005 when i met wife when we got engaged
-couple of letters and eid cards received from wife
-attested photocopies of my new and old passport showing entry and exit stamps
-copy of nicop card
-receipts of money sent to my wife via currency exchange
-calling cards ( with enclosed statement confirming why calling cards have been used because it is cheaper way to call wife and get to talk longer)


anything else that needs to be added ?

my initial appliation was refused due to poor planning. and i want to get it right this time.

Refusal due to 'poor planning'...what was the actual reason was given for refusal? Do you still have legal representation?
