My court date was on April 17th but had to be adjourned. Tribunal has now asked for our appeal bundle and will also ask for an appeal bundle from the Home Office. Just waiting now

Hello both

Have you been told that a decision will be made on paper instead of a hearing?

Did you guys also receive your bundles from the HO after the review? Mine was due on 1st April but we received it last week. The review was actually done on February!

I haven’t been listed for hearing yet.

Hey I’ve just been told that the Tribunal was asking for our side of the bundle and will now give a chance for the HO to give there bundle. If they don’t give there side of the bundle, they’ll make a decision using our bundle. If they do give there bundle, the judge will look at both bundles. If it’s straightforward (which it is) then Insha’Allah they will make a decision using the bundles and if not then they will give a hearing date. That’s all I’ve been told by my solicitor 🤷🏻‍♀️

Does that mean you wont have to attend a hearing?

It just depends on the Judge’s verdict now. If the paperwork isn’t too complicated then the Judge may make a decision based on the paperwork provided. If the Judge feels it’s complicated and requires a hearing, then it’ll be listed for a future hearing.

This is the same with me. It really is taking forever. I was advised by my solicitor we are looking at court dates around August/September time 🙁

Hey I just got a reply from my solicitor. The Home Office are not replying so my solicitor has asked the Tribunal for the appeal to be allowed. The Tribunal refused and have said a CMR hearing will take place (telephone hearing). My solicitor has said hopefully this will take place in July and they have put us on a waiting list for the hearing to take place.

What number did your solictor ring? That is good news, july is better than august/September!

This is good news, it means they are looking in to your case? Have they not asked for evidence before though? Also just wanted to ask did you have a hearing date and was it cancelled due to covid-19? And nope not heard nothing yet, solictor was told everything needs to be in for 7th june and not heard anything

Yeah I’m happy they’re looking into my case. I had a court date on April 17th which was adjourned due to covid-19.

We provided evidence before. Through HMRC they got a false figure of my earnings & they sent an email to send them evidence which shows I earn £18600 +. Insha’Allah all goes well....

Oh okay, did your solicitor submit new evidence or the same when you sent everything in?

As my refusal was based on financial requirements, there’s no new evidence to provide. My solicitor just went in depth regarding the refusal and how my wage slips and hmrc records show at the time of application I was earning above the required amount.
