Spouse Visa Extension - Married

I am due to renew my wife's visa soon and need help with the facts and figures. I am planning to use my partner's earning as a proof of earnings which is above than the required £18,600.
  • Can someone send a sample letter which she would need from her employer to confirm her proof of earnings?
  • I am on Universal Credit and on self employment but she is working and meets the earning requirements. Does that effect in any way?
  • Am I able to apply to waise the application fees for her?
  • What is the list of documents required for the spouse visa renewal for married applicant?

She must have an employment letter that states her income. Just a simple letter from HR confirming that. Also stating when she started, salary and position. No long epistle required.

Same as you used for the first application without the chats/phone logs this time. Letters showing you live together (6 joint or 6 individual letters each)

The employer’s letter should confirm:

you or your partner are employed there
the job title or position you or your partner hold
how long you or your partner have worked there
the type of contract (for example, permanent, fixed term)
what you or your partner earn before tax and National Insurance
how long you or your partner have been paid your current salary
the payslips are genuine
You’ll be told exactly what documents to provide when you apply online.

That's not the definition of sponsor. When your spouse was applying for her initial spouse visa, you told the government that you can afford to keep her here in the UK without relying on public funds.

In this case, you're just the reason for her being here in the UK as your spouse, not her sponsor like you're thinking. She earns the required minimum £18,600. She can pay.

Simple answer is no, she has a source of income which you will provide evidence for, so there is no grounds to ask for a weaver of application fee.

Fee waiver would apply only to people who are applying based on human rights grounds, so not for spousal visa applications. So the form you would need to submit will be different, your wife will move to a new visa and her ILR clock will be reset to the 10 year route, as @AmazonianX has mentioned above.

The sole consideration on whether someone is eligible for a fee waiver is an affordability test to assess whether the individual has credibly demonstrated that they cannot afford the fee. This applies when the applicant does not have sufficient funds at their disposal, after meeting their essential living needs, to pay the fee.

Fee waivers should be granted if the applicant has credibly demonstrated that they meet the affordability test or are destitute or at imminent risk of destitution.
If your wife earns the minimum income requirement, she will almost certainly meet the affordability criteria.

Can I check if my spouse needs to give the IELTS test again or if she can use the same IELTS passed with B2 CEFR level certificate date January 2019?

Is it okay to use the same January 2019 certificate for the extension after 2.5 years?

Yes, if she used it for your first application.

She passed IELTS in B2 CEFR Level in January 2019 which was only valid for 2 years and is now expired in August 2023. Can she still use this cerfiticate which is expired?

Was the certificate used previously for a successful application/was this what was used for the initial visa application?

Yes initial application was approved based on that ielts certificate issued in January 2019.
