Spouse Visa Financial Requirement Calculation

Hello everyone,
I am about to submit my Spouse Visa application, and would like someone to check if I'm applying under the right category.

Employed longer than 12 months, Salaried employment in a Government department.
Lowest monthly payslip in last 6 months : £1523,
Total overtime in last 6 months £248,
Gross Annual Salary £1523*6= £9138+248/6*12 = £18771.00.
Am I right in applying under Category A?

AIUI UKVI will take the lowest under Cat. A and multiply by 12.

So they discount the overtime? Dont they take the lowest month and add up the overtime, divide it by 6, then add the average for 1 months overtime to the lowest month, then multiply by 12?
If they count overtime as the guidance says, then how if they only take the lowest month and dont add the average overtime over the last 6 months to it?

I'll have to try Category B, as my last 12 momthly payslips total over £18900.

1. I think if you know that it is a salaried employment then you should apply as a salaried employment.
2. My husband is in the same situation and we rang the Home office to confirm it and they told us that as long as Overtime, Bonus or Commission based pay has been received during the 6 months prior to the date of application, then it will be counted as a separate income.
3. However, they said that it must show on payslips along with the salary.
4. Also it does not make difference in which month you received it (received every month or just a month as long as within those 6 six months).
5. The main point is that overtime or any other related income needs to be on a payslip separately as told by Home Office.
6. If that is the case then I would advise to add a cover letter on how you meet the requirements.
7. If not then you should ask the employer to state that in the employment letter that £248 has been earned as overtime on top of the salary.
8. Also read the Page 30 on Financial requirements and it explains that all overtime is counted as income followed by an example and yes it is counted on the non-salaried employment calculation.

In your case,

£1523x12=18276
£248/6x12=495.99

Total income as at the date of application would be £18771.99 which meets the requirements.


9. Normally in a salaried employment you get a fixed pay every month subject to minimum hours.
10. Does it say on your payslip Salary or hourly rate?
11. If it does say hourly or different information then you might be able to apply ( more than six months within Category A but non-salaried) or read the page 19 which explains about the non-salaried employment.
12. Also your employment contract would state details about your job and how you are paid.
13. Also see what other members say about it.

1. I am not sure that how you would be able to apply under Category B as you are employed by the same employer which is also your current employer for more than six months as stated in your post.

My payslip does state "overtime" and "unsocial hours", and it's on a separate line from the monthly salary. I work for HMRC so the payslips are the same as the ECO checking them. I am considering category B as my income has varied over the last 12 months, but the total is over 18600. I just want to make sure they count the overtime, and not just take the lowest month, which is £1523. The £248 overtime is for December 2015 only, and I want to make sure they'll average it over the last 6 months , which would put my total salary above 18600.

Thanks for your excellent advice Jagoo, I think I qualify under category A having considered your advice & checked the guidance.
I've worked it out like this:

Gross annualised pay calculation:
Base Salary:
£1523*12 = £18276.
Overtime & unsocial hours payments:
£248+£17+£17 = £282/6*12 = £564.
£18276+£564 = £18840.00
